item not arrived, what to do next??

  • well, here's an update and another question,

    I got the guys phone number from ebay and my partner phoned him last night to ask politly what was going on, his wife answered and said he was at work and didn't know when he'd be home as he works until the job he's doing is finished, but she would get him to call us when he did get home, she said she didn't know what was going on with the playstation, she thought he might still be waiting to hear from the post office.

    Well we waited and waited but suprise suprise no phone call and no email either so I think I'm going to start the chargeback request and see if that wakes him up a bit.

    The question now is on the form for the claim there is the question
    'when you contacted the seller, what happened?'
    there is a drop down box with the options no response
    seller was uncooperative
    seler was cooperative
    or did not try to contact seller

    now what do I put because at the begining he was a little cooperative but isn't being now, actually as I write this I think I'll put that he was uncooperative because he has only contacted us with a lot of promting and hasn't really helped us,

    What do you guys think?

  • i would put uncooperative because if they were they would have either tried to contact you or tried to resolve it on the phone with you, i have just had the same problem getting a gameboy colour, the seller finally sent it after i opened a dipute with ebay dispite god knows how many emails and phone calls, he then had the cheek to turn round and say i was just pretending i had not recived it and was very rude to me (my seller had 1142 100% feedback)

  • ok sorry vicky but i didnt want to start a new thread and had a similar question...if people object i will create a new thread (with the same title!)....

    i bought an item recently (15aug) that was relatively cheap (under 30£) and the Seller's payment instructions stated

    "PAYMENTS EXPECTED MAX 5 DAYS AFTER THE END OF AUCTION.IF PAYING BY PAYPAL PLEASE ADD 5% INSURANCE IS RECOMMENDED(£0.65) AS I WILL NOT TAKE RESPONSIBILITY FOR LOST OR DAMAGED PACKAGES"

    i paid up the paypal extra because didnt have time to contest it..but that was minimal anyway, but needless to say the item did not turn up and i didnt pay the "extra 50p insurance" because i asked the seller to get a COP because the item was less than £30 i thought this sufficient.

    anyway after correspondance with the seller I dont think i am getting this item, the seller seems cooperative and i want to beleive her but the most recent reply had the dreaded
    "as i do say in description i take no responsability for losses as i do advise to take insurance"

    she said she would go to the post office and get them to investigate it tomorrow but she seems to have implied that she has already previously been to p/office before...

    anyway should i start chargeback or wait for p/office response? opinions/help please

    I'd start the chargeback. With the seller charging for Paypal, any protection she may have had on the sale will have gone out of the window and like you say, with the item being under £30, you didn't need to pay any insurance as a COP is sufficient should the seller need to claim for a lost parcel.

    Sellers cannot charge buyers for Paypal and can be reported for it.

    With you paying by Paypal, the seller should have sent it by trackable means anyway as she cannot prove to Paypal she has actually sent the item.

    Like shellnsteve says any insurance on an item is to protect te seller not the buyer, so start a paypal chargeback immediately, don't warn the selelr first though, just start the chargeback.

    If the seller cannot prove delivery then paypal will find in your favour whatever silly terms and conditions the seller puts in the auction. Also, again as shellynsteve says the seller has lost any seller protection anyway by surcharging for paypal.

    Advice for the future: sellers that don't understand how paypal works are best avoided. Yes you have the option of a chargeback but if the seller doesn't sell a lot then there is the chance there will be no money in their account to repay you, and it becomes a hassle.
