item not arrived, what to do next??

Hi,
I need some help, I won an auction on the 12th of august, a playstation2 with 37 games, and paid that day by paypal, £251 , now it still has not arrived, there has been a few emails back and forth saying that he waited for the money to clear into his bank account before sending the stuff, and then saying that he'd been to the post office and they were looking into it and would get back to him the following day, that was on thursday evening so I was expecting to hear from him friday, but haven't , I've sent him a couple of emails saying had he heard and telling him I'm getting a bit anxious,but I've had nothing back .
I'm not sure of what to do now am I being paranoid about the fact that he waited to have the cash in his bank before he apparently sent it, do you think he was just stalling?, what can I do i.e through ebay? and how long sould I wait?, do I have to do it before a certain time say 4 weeks from the auction end?
sorry for it being so long but I just don't know what to do I've never had problems before and it's quite a lot of money to lose.
can I claim through my credit card ?

Ask the seller if he has some sort of proof that the item has been posted out to you ( ask him to send you a pic of it or a tracking number )and by what means ie standard parcel or special del.
The Post office wont admit the parcel is missing till the 15th day after it is posted.
You have upto 45 days to start a chargeback but Imho i would start a chargeback via paypal asap . if the parcel does turn up you can always pay for it again.

Yes I agree. Paypal expect items to be despatched in a timely manner and this is beyond that.
Start the paypal chargeback today, don't warn the seller first though, just start the chargeback. If the item arrives in the next week then all you need to do is cancel the chargeback.

The phrase that sticks out here is "waiting for money to clear to his bank" stands out.He doesn't need to do this with PayPal I would start a chargeback immediately. What is his feedback like? Is he still selling? I would suspect the worst here I'm afraid. You could easily get the e-mail from PayPal saying that they have been unable to retrieve funds from his PayPal account.
Pull his details as well and check phone number is kosher and find out through 192.com if that surname is on the electoral role at that address (might not be possible).
Get cracking on your chargeback!!!!
The next step is a claim through EBay but that is very time consuming affair and will cost you £15.0 -
One other thing you can do. Check what else he has sold recently and contact the buyers with a polite e-mail asking if all went well with the transacation.

Because it was paid for via Paypal eBay won't do a claim, it has to go through Paypal BUT there is no charge for this.

He is still selling when I checked a couple of days ago he has 3 things on all small baby toys
If he has already taken the money from his paypal account does that mean the chargeback will be unsuccessful?
I have checked his details on 192.com and all is well it also has his wife( same surname ) on there which is the name on the paypal account so that all seams ok.0 -

It doesn't really matter if he has witdrawn your payment from his account as paypal will take any money he currently has to repay you if they find in your favour. That's why we often ask whether he is still selling, if he is then there is the chance that more money will hit his paypal account and will be earmarked to repay you.

If PayPal can not retrieve your money you can put a claim in through EBay, all correspondence goes to Germany and they take £15 off the top.
If money is not in his PayPal account you could struggle getting the money back from them.
On the other side of the coin this might just be an ultra cautious seller...but that is no excuse for taking this long.
Once you put the chargeback in if he is genuine you should have an e-mail from hom very quickly asking what is going on.0 -

how much feedback do they have?
how far away from you are they?
i'm currently in the process of chasing down a bloke over £70 he's ripped me off by not sending an xbox, its pretty easy to do, i know his full address, his parents names, his college and 5 of his email aliases :-)
going down the small claims court tomorrow :-)money saving my @rse.

I forgot to say that he has got 100% feedback but it's only 44, 17 of which are from buyers, I'm going to give him until tomorrow evening, because of the bank holiday, then start the claim, I just hoping that he's gone away last minute or something and that he'll email me tomorrow.
I'm such a wishful thinker aren't I.
