    Nemos responsibility

    At the point of sale there was no requirement for Nemo to provide a verbal explanation of all the significant features of the policy and FOS have not provided evidence to the contrary. The customers were provided with enough information to make an informed decision whether to proceed with the purchase of the insurance policy

    Summary

    The facts do not support the findings of FOS.It appears that FOS has based its findings on personal opinion only rather than reviewing the evidence available and applying the regulatory requirements in place at the time of the sale

    so I am not a happy lady.

    Laini, was it now with the actual ombudsman or another adjudicator. I cannot believe it and gutted for you, I really am. What cheek they have... :mad:

    Lets hope other companies don't follow suit with these in that they will all fight back against the FOS...:eek:

    This was the second time was it not already. I thought it went before the ombudsman after the first time:confused:

    I know the actual ombudsman stage is the last stage, so if the firm do not agree with the adjudicator, they request for it to be reviewed again but with the ombudsman.

    Like Laini's this is what happened to me with mine, that is why it had taken just over a year !!!:rolleyes:

    I do hope they sort Laini's out earlier though as soon as the ombudsman assesses this, fingers crossed for her.;)

    OMG they are barstewards. Can we get this in the media somehow. I know companies are awkward but what about "treating customers fairly":rotfl:Makes you laugh does it not.

    What about Mail on Line if we could do a story e.g. history with letter from Nemo etc whether they would be interested.:eek:

    Laini's was turned down ages ago and then went before the Ombudsman being this one i thought. So does it go to two adjudicators before then cause hers had already been to one and was turned down this was to do with the second one???:confused:

    thanks for the support

    I too thought it would only one adjudicator but we have had to go through another adjudicator.
    it is now being handed to an Ombudsman.
    1st October is the last date we can send anymore info to add to our case.
    The adjudicator sent us a copy of the letter they recieved from Nemo.

    dont need bad news at mo cos of not being able to get a job its adding to the stress of it.
    still fighting for my money !!!

    Hi there Marshallka & Laini.

    Laini I did take mine to the media, and funny enough I was looking through the SAR earlier on - on Nemo's comments of when I done this lol.

    Do the same hun, one of those was with "Thisismoney".

    Now from what I can remember, from mine, its with a caseworker, then moved on to the adjudicator, if not successful the last stage was the ombudsman.
    I am sure there is some info on their site about this, maybe a video too, if I come across it I will add it.;)

    Trying to remember the dates of my case Nemo/FOS.

    Complained to the FOS NOV 2006

    First letter DEC 2006 to inform me this was received.

    JAN 2007 letter from FOS to say this was in a queing system waiting to be passed on.

    Letter from Caseworker/ADJ:
    March or April 2007 Case upheld but to be passed on for further investigation because Nemo requested this.

    AUG 2007: Provisional decision sent from Ombudsman to confirm still upheld but Nemo requested more time to send further information.


    OCT 2007 Final decision: Letter from Ombudman to confirm this was mis sold/upheld.

    Paid out Jan 2008

    Nemo stalled with everything !!!

    So I know how Laini feels, and of course just before this was paid out and after all that messing my husbands steelworks closed down with no notice, no pay, redundancy or nothing for the 400 workers, it went through the liquidators !!!
    with only him working too with 2 kids it was a very tough time !!!

    From what I understood if one adjudicator could not reach agreement it went to second but it was unusual for one to over rule the other. It them went on to Ombudsman who's decision was final. But want to know if that correct:rolleyes:
