Checking insolvency legislation and regulation and not clear re retention requirements.Whow! ... my books on insolvency, tax and company law are massive and been ages since trawled through them!!! :eek:

Hi, i sent my acceptance form off on the 29 august 08, rang BOS/halifax today,and they've said they havent yet rec'd it from FOS. How long do i have to wait? can anyone tell me how long they have had to wait with BOS/HALIFAX?

Had an email back from FSCS saying they can't give a timescale for picture being declared in default (how depressing!)
They also added a paragraph that said that even though claims may have been upheld by FOS or Picture they have their own rules to follow to see if a claim can be upheld. So now I am not so confident. Not that my claim has been looked at by the FOS or Picture, only by FCSC, but I am now wondering how they differ.DS1 12/10/04

You could always ring the FOS, we did with ours and this nudged them on a bit, so give them a try hun, it will do no harm.

Hi all, I've just added a copy of the GISC Rules for the sale of insurance to private customers between 2000 and 2005 to the sticky at the top of the PPI section on CAG. Rather than clog up both websites with the scan of these images, I'll just suggest that if it's of interest, take a little look on there!
These Rules do not appear to distinguish between advised and non-advised sales. One of the requirements is to clearly explain any significant or unusual restrictions or exclusions and also any significant conditions or obligations which must be met by the customer.
Also about providing enough information to make an informed decision................offering products and services whcih do meet the customer's needs......................identify the needs of the customer by obtaining relevant information from them.....................bla bla bla.
You know, all the things that insurers tend not to do!
Also had a look at the 'Treating Customers Fairly' section of the FSA website as it does mention the sale of PPI within it.

Poor practice found included:- Not explaining the PPI product clearly, including significant exclusions and limitations of the policy.
- Failing to ensure the customer was eligible to claim against the product.
- In advised sales, not finding out whether the PPI policy was suitable for the customer
- In advised sales, poorly put together statements of demands and needs that did not explain the firm's recommendation or tailor the information to the individual customer.
- Inadequate systems and controls in place around the sales process. These could result in sales staff not following the firm's own processes, and ultimately for inappropriate sales practices.
Almost debt-free, but certainly even with the Banks!0 -
