PPI Reclaiming discussion Part II

Still seeking advice on the wifes Debenhams card.
In summary:-
They sent CCA which shows no PPI required
They sent SAR stuff (some of it) most interesting being a list of customer contacts
I wrote saying no PPI should be on there.
They wrote saying my wife phoned them (not on afore mentioned Customer Contact)
I wrote asking for proof.
They wrote saying they didn't have any but won't pay up.
I need to know how to start the court procedure or do I need to send them another letter first. The misses wants me to chase them now after telling me at first that she'd get nowt.0 -

This is going back to 1996 isn't it? When did the ppi start on the card? Was it as the date that the contract came into force.
Tiggrae is your best bet for the courts route. She will no doubt be on later.0 -
Whats the difference in law as to an advised sale and a non advised sale???
I have only just realised that my ppi was said to be non advised and this is so untrue as according to the FSA fact sheet a non advised sale is when no personal recommendation is made to the customer. I wouldn't call putting something onto an agreement that was not asked for "non advised". I would call it compulsory as mine was a condition.0 -

Yes. It was then cancelled when GE Money took over and immediately reinstated. I only know this because that info was included in the SAR. Hence my concern that no customer contact regarding initiation of PPI was recorded in the list of 'important events'.0 -

Slight misunderstanding. Never asked for never cancelled never reinstated. GE kindly managed these transactions by themselves.0 -

I took out an £8000 secured loan with Swift Advances, 6 years ago this very week. There's a year left to run on it. According to my credit agreements I've paid over £1700 of PPI on this loan. The thing is, I really can't remember if it was forced upon me, or if I chose to take it out. On the credit agreements it says optional but it's so long ago now I just can't remember. Would I have a chance of reclaiming this money? The insurance was never used. Any advice whatsoever would be very much appreciated.0 -

Have you requested a SAR hun ? (Subject Access request) for this account.
If not I would do this, if you need a template someone will help and guide you to this, but its worth paying a £10 cheque payment for, because they will or should provide you with everything, all information on accounts from the start to finish, even if your still under them.;)
When you recieve the SAR which should be with you by the deadline date, which is 40 days from on the day they receive your request.
Recommended to send by recorded post so that you can track this down in the royal mail website.;)

Thanks a million, Di. No, I haven't requested a SAR, never heard tell of it and haven't a clue what it means! Is it copies of the forms I filled in? All I have to do with the loan is the credit agreements.0

Right,you could request a sar from them (subject access request) and then you will get all the information that they hold about you and also any telephone conversations they have too all for £10. This may give you some indication as to whether you opted for it or whether it was put on by them. If it was put on by them then if you take a look at martins guide down the right hand corner you have to decide whether to go for the misselling. You really shoud be able to tell if you could of used it.
Was it a front loaded policy and paid up front, if so were you made aware of this? Was it for the full term of the loan? Were any medical conditions asked about prior to this? These are all things that you could read about then request your SAR and find out how you bought it.Some of these policies are ok and needed but if you were say "self employed" there are clauses whereby you have to have been self employed and paying ni (class 2). Take a look and get back with any questions.
