Ok if no reply send them a letter saying in reference to my previous letter dated stating that as per the previous letter you now accept that they have made their final decision in the matter having been given more than adequate time to respond. Therefore it is regret that you now are going to carry out the following actions.....

Hi all, new poster, looking for some advice.
My step dad is self employed and always has been. He took a loan out with Lloyds TSB and was told that because he was self employed he had to take out PPI else they wouldn't give him the loan. He agreed. A couple of years ago he contacted them and asked to cancel the PPI but was told that he couldn't. He said he looked at the T&Cs on his agreement and it said he could cancel at any time.
I told him he may have a case to reclaim his payments and to get a copy of his paperwork from the bank (he couldn't find the originals). When he was there yesterday they told him that the PPI was justified because of his self employment, and that he had to have the PPI for his public liability insurance (he's a brickie who was sub contracting to a building company but has been self employed all along).
I think this is rubbish and that his public liability insurance is completely unconnected to PPI. From what I can gather it's illegal to refuse someone a loan if they don't take PPI, and again it's illegal to refuse to let someone cancel it. Is that correct?
He took the original loan out about 9 years ago, but added some extra to it around 5 years ago. He's still paying it all off now.
Any advice? He's just been laid off so money is tight, it would be great for him if he could get some cash back.

Hi sent letter asking for list of charges plus a cheque for ten pounds to Lloyds on 10th January, cheque was cashed 22 Feb but heard NOTHING since, is there a certain template letter on this site i can use or jst draft one myself? or will they ignore that too, Prefer to keep things in writing so dont want to ring.DFW NERD....560

Hi phone the information commisioner straight away and then send the proof ie bank statement, original letter and copy of cheque stub so that they can verify that the information still hasn't been provided.0 -

Ok if he has stopped working because he can no longer then by rights he should have furfuilled the conditions of the PPI and therefore should be able to utilise this to pay off the loan. If they refuse this then it is at this point that you should attempt to reclaim the PPI as it has been mis sold to your father.
Again to the verification of the law reference PPI. The PPI was optional and therefore wasn't necessary to enable him to gain the loan. The PPI if optional can be cancelled at any time and no company is allowed to refuse a refund of said PPI (as per the OFT's ruling on nil returns policy's). Also check because when your father topped up his loan there was a good chance that instead of just adding to the original loan they would of created a new one so he might of been the brunt of a disproportional rebate by the company.
Tell him to attempt to utilise the PPI first and if they refuse then pass the case to the FOS sighting that he can't work and this debt and refusal the companies side will put him in financial straights and hopefully they will fast track the claim.0 -
I have just had good news really when i spoke to firstplus about my letter of complaint. I orginally thought my loan that was taken out in 2000 was settled in 2002 and over six years ago and then when i spoke to them today i have found out i settled in April, 2003. Does that mean i have a claim now. Also i was told (the bad luck) that we used a broker "Freedom Finance". I can't remember using them. How do we stand now. Do we claim from Firstplus (that is where i have sent my complaint to) or Freedom Finance. I have tried to look back on this thread and their is so much contradicting advise. I need to know exactly. Is the consumer forums that right place to look. Advice much appreciated. Also anyone had any luck with Freedom Finance.
Can i now join the "claim gang" and if anyone is working for the "claim gang" please could you help. Also something else i remember when settling my loan with Firstplus. They said my husbands wages were down as about £10k more than they were. We had sent P60's and wage slips in too but i never pursued it as we were wanting to settle. Could the broker do this.0 -

He actually only has 2 months left on the loan, so would benefit more if he could reclaim the whole of the PPI payment across the life of the loan rather than them just paying out the final two payments. I've advised him not to put an unemployment claim in yet, so that I could find out first whether he has a case for claiming the whole lot back, based on the fact that they told him he had to have it to qualify for the loan, and then wouldn't cancel it when he asked.
Regardless of the fact he's now out of work, would you say he has a case? Even if he hadn't been laid off last week and was still in employment now, I think he was mis-sold the insurance in the first place, and should have been allowed by law to cancel when he asked. Would you agree?0 -

That is good news as it is within the 6 years anyway. If firstplus are denying responsibility then yes get in touch with freedom finance (remember letters only no phone calls, evidence later on):

stating your case and if they refuse then take it to the FOS and complain that neither company are taking responsibility from the situation that has occurred. If you are in doubt whom to chase get someone (OFT, FOS) to do the donkey work for you.0
