Thanks for that sarah, i have emailed the FSC in Gib and hopefully they will reply. I have asked for details of Bespoke and whether they were regulated to sell insurance and if they should be. I have actually spent the morning finding review sites to put my ten pence worth a review of freedom finance and to let people know its ok until you have a complaint and then the complaint is dealt with (if they feel like it) by Gibraltar as Freedom only do the processing of the loan. I will continue to slate them on as many sites as i can.

I have also written a letter to Bespoke and put a copy of my actual agreement in. I have never wanted to deal with these direct as i feel that by doing this i am admitting to something that i feel is lies. I have worded this as best i can and also by dealing with them if what tiggrae says is true then even if they say " here is your money" "come get it" i have no way of enforcing it from here. I suppose i could take my next hols their and pay them a visit.
CALLING ALL AFFECTED BY FIRST PLUS / FREEDOM FINANCE / BESPOKE FINANCE UNHOLY TRINITY - I've just received this from the Financial Services Commission on Gibraltar - everyone affected needs to contact them about Bespoke Finance - let's us all put 'a SPOKE' in their wheels !!!!

    Thank you for your enquiry.

I can confirm that Bespoke Finance Limited is not regulated by this Commission. Bespoke Finance Limited is a Gibraltar company (Incorporation No.60921). You can obtain further details about the company from Companies House in Gibraltar (www.companieshouse.gi)
We have received another enquiry concerning this company, although the nature of the activity in that case is loan finance, which is not a regulated activity. Perhaps you could provide copies of the PPI policy so that we can give you a more substantive response? This would enable us to take a view as to whether the company's activities require authorisation (in which case the Commission may consider enforcement action).
    Yours sincerely.

    Hi,

I do not work due to having MS and Social anxiety.

I have recently taken out a debt management plan as I got myself in a bit of a mess.

I have two personal loans with the Alliance and Leicester and have PPI on both. The first one I did on the internet and the second onbe over the phone.

I have been honest about my non employment and my medical situation, but was advised on the phone to take out the insurance.

    Any advice would be appreciated.

    Elaine.
you've an excellent basis for reclaiming so go for it !!!!

I posted the above yesterday hoping someone could give me some general guidance but no response - is anyone able to help?

    Thanks
Hi there, it's not a full and final offer so you're OK in accepting it - if it were a full & final they would have asked you to sign a document to say so - so carry on with your claim !!!!

    Hi folks

A letter received from HBOS followng my default judgement award by the court:-

    Dear *****

"I have received a copy of the judgement you obtained again BOS on 22nd May.

You may be aware that on the same date I attempted to file a defence on behalf of the bank.

The bank believes it has a good prespect of defending your claim and therefore it intends to apply to have your judgement set asise. Once the application is made any attempt by you to enforce judgement will be suspended.

You should hear from the court within two weeks

    Yours sincerely,

    ***** "

I am in limbo. I want to submit a warrant for execution but, as above, the bank is saying "it intends to apply to have your judgement set aside. Once the application is made any attempt by you to enforce judgement will be suspended". I was awarded defualt judgement almost a month ago. I am worried that if I do apply for the warrant, it will be a waste of time as the bank is syaing it will apply for it to be suspended.

    Advice??? Thanks
Yes, you're correct paying for a warrent of execution would be a complete waste of money - you need to contact the court and ask whether HBOS have filed a defence and whether they've received an application to have the judgement set aside.

I emailed this to them just before and i read this

I have a complaint with a company who process loans on behalf of a company based in Gibraltar and wondered if you could help. The company is called BESPOKE FINANCE and their address is as follows.
    suite 2c
    eurolife building
    1 corral road
    gibraltar
I wondered if you could tell me if they were authorised to sell finance in the year of January, 2000 and also the sale of insurance products too. If they were not should they have been required to do so. Also i need to know a date in which this company was first set up there. If you could help as soon as possible i would be most grateful.

How do we stand now tiggrae and is there an email address for this person

This was a reply i got from them ages ago when i asked about them

Loan finance (lending) is not a regulated activity in Gibraltar and therefore this Commission has a very limited locus in this matter.

    Hello all,

I currently have a mortgage with Nationwide which I am paying £53/month PPI
I suspect that i have been paying PPI on this for many years without really knowing about it.
The bad part to all this is that I am insured for accident/critical ilnness, life, unemployment and health through Nationwide and their preferred underwriters already. In fact I was sold sold the extra insurances along with the PPI by the same salesperson.
This to me sounds like I might be able to claim for many many years of mis-sold PPI payments.

The part that is bothering me is the consequences of doing so. I am currently applying for a third mortgage with Nationwide to cover the cost of a house move, this application is currently in progress and I do not want to do anything that may upset the apple cart right now. So it's best if I wait until I have the mortgage agreed and the balance in my account before i submit any claim right ? I will ofcourse cancel the PPI straight away anyway,
So, I get my mortgage and pay the right level of insurance without PPI, then I claim against them..... what happens to me ? Would i be asked to leave Nationwide as a customer as per my experience with credit card refunds ? ... what exactly are the consequences of reclaiming PPI ?

    Rgs

    Onslo
Given the current state of the credit market I would definately wait until after you get your mortgage sorted. Once in place start the reclaim process, it should make no difference to your relationship with the Nationwide as they can only request the full repayment of the mortgage if you get into arrears

This is a plea to Tiggrae - please could you offer some advice regarding Picture Loans - they added the whole of the PPI (£11,227) onto our loan amount £45,000 and we now are selling up and repaying the loan after just over a year. Do we have a claim - I think it might be under the single sum (?) category and they did not mention that it would only be effective for 5 years. How do they justify £11,227 for just 5 years' worth of cover (BTW the loan was for 25 years). We were definitely under the impression that we had no choice but to take it?

We have no separate paperwork for the PPI part of the loan. Should we have?

    Please advise if you can.
YOUR = belonging to you (your coat); YOU'RE = you are (I hope you're ok)

really....it's not hard to understand :T

FSMA did not apply in Gib at that time.
thanks for that, i think this was told to me in an email from the FSC in Gibraltar but i just want more people to keep on for their money back from this company as they are hiding behind this fact and are ripping people off left right and centre. Its so wrong and i will get to the bottom of this somehow and thanks for your input and look forward to anything else you can help with.
