PPI Reclaiming discussion Part II

Hello all,
I currently have a mortgage with Nationwide which I am paying £53/month PPI
I suspect that i have been paying PPI on this for many years without really knowing about it.
The bad part to all this is that I am insured for accident/critical ilnness, life, unemployment and health through Nationwide and their preferred underwriters already. In fact I was sold sold the extra insurances along with the PPI by the same salesperson.
This to me sounds like I might be able to claim for many many years of mis-sold PPI payments.
The part that is bothering me is the consequences of doing so. I am currently applying for a third mortgage with Nationwide to cover the cost of a house move, this application is currently in progress and I do not want to do anything that may upset the apple cart right now. So it's best if I wait until I have the mortgage agreed and the balance in my account before i submit any claim right ? I will ofcourse cancel the PPI straight away anyway,
So, I get my mortgage and pay the right level of insurance without PPI, then I claim against them..... what happens to me ? Would i be asked to leave Nationwide as a customer as per my experience with credit card refunds ? ... what exactly are the consequences of reclaiming PPI ?

Where Freedom Finance actually quote "Processing on behalf of Bespoke Finance" and "These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. Disputes arising here from shall be exclusively subject to the jurisdiction of the courts of England and Wales", there are actually restrictions to this statement. Am i correct.0

You can use your local county court for proceedings in Gibralter, but you can't instruct bailiffs as UK bailiffs have no jurisdiction in Gibralter - it is a total Mare and obviously this has been set up deliberately to avoid people being able to reclaim for mis sold insurance !!! Best thing to do is contact the Financial Services Commission in Gibralter and made a complaint !!! Also, write back to Freedom asking how a firm work for them which is not licenced in Gibralter to do so !!!!

I believe under the Consumer Credit Act the seller of a product has to identify themselves, I think this whole bespoke thing is a smoke screen. If you can't go to the FOS then the next recourse is the County Courts - and I would definately identify Freedom as the defendant - as under UK court jurisdication you can sue a company in Gibraltar, but the UK bailiffs have no inforcement authority, so you could win your case but if they don't pay up you've no means of getting your money !!! They've been quite clever S**Ts !!!
and this too
What people need to do who have been affected by this is contact the Gibraltar Financial Services Commission and make a complaint against Bespoke for operating without a licence, lets see if we can't smoke them out, the more people who complain then we could get bespoke shut down and Freedom won't have anyone to hide behind !!!
Or write to BBC Watchdog and expose this scam
I don't know how true this is but i would think tiggrae knows what she is talking about.0 -
Hi folks
A letter received from HBOS followng my default judgement award by the court:-
Dear *****
"I have received a copy of the judgement you obtained again BOS on 22nd May.
You may be aware that on the same date I attempted to file a defence on behalf of the bank.
The bank believes it has a good prespect of defending your claim and therefore it intends to apply to have your judgement set asise. Once the application is made any attempt by you to enforce judgement will be suspended.
You should hear from the court within two weeks
Yours sincerely,
***** "
I am in limbo. I want to submit a warrant for execution but, as above, the bank is saying "it intends to apply to have your judgement set aside. Once the application is made any attempt by you to enforce judgement will be suspended". I was awarded defualt judgement almost a month ago. I am worried that if I do apply for the warrant, it will be a waste of time as the bank is syaing it will apply for it to be suspended.
Advice??? Thanks0 -

I can't imagine how frustrated you must be - there's addresses and tel no on that link I sent you - maybe you should contact them and put a complaint in and ask if they have any adviceLTSB PPI - £770 ish for dad

I have also written a letter to Bespoke and put a copy of my actual agreement in. I have never wanted to deal with these direct as i feel that by doing this i am admitting to something that i feel is lies. I have worded this as best i can and also by dealing with them if what tiggrae says is true then even if they say " here is your money" "come get it" i have no way of enforcing it from here. I suppose i could take my next hols their and pay them a visit.:mad:0 -
I posted last week about being charged £6300 by GE Finance as a single premium for PPI when i ddin't even tick the box on the application. The loan was apparently arranged by Credit Link who have gone bust so i have been dealing with GE Finance direct in trying to get my money back.
GE did write whn I repaid the loan and offered me cancellation of the plan and a refund of part of my premiums so i wrote and said yes I did want a partial refund but that i was currently in a complaint with them about misselling of the PPI on the grounds of not ticking the box but being charged for PPI and i actually wanted a full refund.
Anyway when i got home on Friday there was a letter (after ignoring my last 3 letters) just saying
"With reference to the above numbered account we are writing to confirm that the sum of £472.50 has been paid direct to your bank account detailed above."
No explanation why this amount, no breakdown but by my calculation £6300 over 5 years is a premium of £105.00 per month and I cancelled the PPI 23 months early so by my calculation that's £2415.00 - I know they can deduct admin charges but £1,942.50 of them? That's ridiculous isn't it?
Anyway on Thursday last week I sent off for my SAR and also sent a letter threatening court action and mentioning the Negligent Act etc... plus querying whether the loan was valid as it didn't appear to have been executed in line with the application i completed - this was as mentioned by HomerJ.
Is it not sneaky of GE to pay the money into my bank account so i looks like I've accepted their refund?
Do i carry on fighting and what do i do about the money in my account as I don't accept that £472.50 is a fair refund.
I posted the above yesterday hoping someone could give me some general guidance but no response - is anyone able to help?

Hi,
I do not work due to having MS and Social anxiety.
I have recently taken out a debt management plan as I got myself in a bit of a mess.
I have two personal loans with the Alliance and Leicester and have PPI on both. The first one I did on the internet and the second onbe over the phone.
I have been honest about my non employment and my medical situation, but was advised on the phone to take out the insurance.
Any advice would be appreciated.
