Hi all
I have an ongoing court claim with LLoyds TSB and about to do another for Lombard Direct. Does any one know any court failures with either of these?
Bit nervous as Lombard over 9k and dont want to lose claim! FOS really slow as got a different financial query they are sorting out and after two months has still not been looked at.
Also have referred to info commissioner a complaint as LLoyds TSB ignoring repeated requests for copy of document. Does any one have any experience with info commissioner?

Hi. I had to refer a case to the ICO over a breach of the data protection act. They took about 4 months to make a ruling, but it has been pretty handy as I am now using this in court against the company that screwed up my credit history.MSE - The Stig0 -
I FINALY GOT AN ANSWER FROM Barclays and they are refusing to pay any mony back.
I had a single premium policy, which i paid off earlier, in a letter Barclays said all the things that i already knew,eg. amout of loan and etc. but doesn't say anything why i have not been explained properly and that loan did not cover the full term. I would like to write a "clever" letter back as they say this is not their Final Response. Can you tell me how i can found Part 1 of Discussion?, maybe i can look at some other threads, can you help?

Have you been Mis Sold PPI. (Some standard Conditions for PPI)
a) Payment Protection Insurance cannot be made a condition of obtaining a loan. (This is the most common reason for mis selling)
b) You are permantley resident within the United Kingdom
c) You are Over 18 and Under 65 at the commencement of your loan, and you will not reach the age of 70 during the insured term.
d) You are in Full time employment – Some policies define Full time employment as being working Over 16 Hours per week and that you have been in full time employment for at least 6 Months prior to the start date of the policy.
e) Pre Excisting Medical Conditions may also Invalidate your Policy
f) Some policies may cover if you are self employed.. Check your T & C first though.
** Latest Additions to be added to above**
1 You were not in work or self employed at the time of sale
2 You were told that you had to take the PPI out at the same time as the loan or not at all
3 You were not asked whether you had any other insurance which would cover the loan
4 You were not told you could buy PPI elsewhere to cover the loan
5 You were sold a policy which had age restrictions which you fell outside of
6 You were led to believe that Payment Protection Insurance was compulsory
7 You were told that you would stand more chance of getting the loan if you took the Payment Protection Insurance
8 It was not explained to you that there were certain exclusions within the policy that could affect you
9 You were pressured into buying the PPI
10 You paid upfront for the PPI but it was not explained that there were some PPI policies where you could pay monthly
11 Your PPI was an upfront premium and you repaid the loan early and received no refund
12 You increased your loan and the PPI was increased automatically
13 The Terms & Conditions of the small print were not fully explained to you

Hi, we took out a loan with firstplus in Jan 2000 for £17,000 and had ppi added of £4163.30. We paid this off for two years and argued about the ppi but was told it was part of the loan as everyone was told then. We then changed over the mortgage and asked for a settlement figure. The figure was about £24,000 to settle. This was worked out on the rule of 78 which i did not understand. It also included the ppi. I repaid this after arguing this and put it down to experience and now that people are claiming this ppi i sent a letter to firstplus asking for a copy of the original loan agreement as i had no records. They have replied promptly with a copy of this.
I have now sent in a letter stating that we were missold this ppi and that also our settlement figure was worked out using rule 78 which is now thought to be unfair. Does anyone think we have a chance of claiming anything back from these crooks. From what i can understand about the 6 year rule thing it is purely that companies don't keep records after 6 years but firstplus have our records as they have sent me a copy.

we are fighting with FP too and are with the FOS
I would ring the FOS or FSA and ask what they can do or you need to do, have a look on their websites too:j:j.

could you not say you complained to FP but didnt realise you could take it to the FOS at the time.
I would send a SAR to FP which shows all letters and conversations you had with FP - this might help.

Hi alleybabes, I'm going for HFCs jugular too. they charged me twice for a PPI I never wanted in the first place and I have the agreement to prove it. What have they done to you?0 -

TOOK OUT LOAN NOVEMBER 2006
we settled in Jan 2008 but had started our complaint to FP in october 2007 so said we would pay the settlement figure they were asking for but would be taking it further for mis sold and unfair rebate to FOS.

Today I have started to fill in the MCOL form, havent got a clue what to put in the section particulars of claim as it has to be no more than 1080 words on up to 24 lines only.
Please do you have any links /info I could use.
Also the loan is in JOINT names, I am the one dealing with it all, filling in forms etc but who should be named claimant...O/H is the one in full time employment and was the one covered for PPI ,although a Joint policy I was only covered for LIFE ins.
And lastly should you tick the box about the Human Rights Act 1998 or not?

Could use some help please.
Took out loan with single premium in Oct 04 loan amount 7000 + 1671.95 ppi at 6.9%. Monthly repayments 170.61 x 60 months
I cancelled ppi in July 07 got a partial refund of £345 only.
Now I worked it out that I was paying £29.79 ppi every month and was expecting my repaymenrts to drop by around that amount, but they didnt they only reduced my payments to £160.50. = £10.11 reduction.
Are their calculations correct because it seems to me that they havent cancelled interest on ppi.
Anyone advice would be much appreciated.0
