Hi, I was wondering if anyone else has had this experience.
After getting no luck claiming back my ppi with Lloyds TSB, I wrote to the FOS who have finally sent me a letter saying that they uphold my complaint against Lloyds TSB and have ruled in my favour. Hooray, however, Lloyds TSB do not like this decision (natrually) and have asked my adjudicator to re-consider her decision. The whole thing now has to go to another Ombudsman to look at afresh and my adjudicator say's that this new Ombudsman may not agree with her decision. Surely this can't be right? If so, do you think the new Ombudsman will go against the adjudicators initial decision? Any thoughts. Thanks.
    possible but not likely

Hi Catmad, Think I am in similar situation with Firstplus,Adjudicator upheld complaint,FP asked for extention to reply to decision, was then passed to senior management at FOS,complaint was still upheld but FP have responded by saying they are unable to respond to decision so it has now been passed to ombudsman for him to issue Final response.I am hoping that it is still upheld and FP are held to account.Dont no if this will be a long process but will update with any news.

1stly- they added what was left of yours to a whole new account - so you'll have paid interest on the new length of the loan instead of what was left on yours - did you have PPI on yours? - if not by agreeing to the new lumping together they have applied PPI to yours in a very sneaky and underhand way

then they added your husbands whole amount to the new account and the same thing happened again

so they charged you both PPI for the whole of the new loan even though he had already made payments

you will have to write to them and ask for a SAR and a break down of all the details in FULL

they never do things like this to benefit the customer - only to rip you off

thanks fot that i have sent off for a sar ill have to wait and see what it says

    thanks again

tiggrae, i asked earlier about the thing i was told by the ICO about data. I said that the phone calls that i had from firstplus on tape kept being blanked when i spoke about things i need for evidence and that the ones where i say about the ppi and not having any documentation about it are not on the tape. The ICO then said that "they wouldn't want to incriminate themselves would they". I thought the whole thing of asking for a sar was for evidence. Also i spoke to FIrstplus today and said to them that they have had a letter from the FOS to which they replied "we will send the information that he has requested to him". I then said that they cannot send any information to him that they have not sent to me. Am i correct or can the FOS request different things.

The misrepresentation act 1967. Negligent misrepresentation is what people are using.

the only plain english i can use for these people is robbing b******s. That plain enough. No seriously, these acts do my head in. I think i actually understand things and then ask someone at the FOS or FSA or trading standards and i have got it all wrong.
  • If you credit card has had PPI added, but you've always been in the red, can you still claim?? Egg have said today that because I never actually 'paid' for my reclaimed PPI that I cannot claim interest?

    Any ideas please?!?

It just seems so unfair - I've already had to wait 6 months for the FOS to make their decision - it seems to more it's a delaying tactic - Good luck to you
