    Morning All,
I'm helping my brother reclaim PPI, he's received his original credit agreement back from Beneficial, he signed the papers in the office of Beneficial, told the person sorting the loan he didn't want PPI, upon receiving his agreement back Beneficial have circled the PPI box, which is ticked. My brother gets full sickness pay for 2 years if he's off work, also 2 years death in service benefit, so he would'nt need PPI. Can he still go for mis-selling of PPI?
    Hope you can help

The answer is yes however again its a case of your word against theirs again but utilising the old mis representation act it makes the ownes on them to prove they didn't mis sell, not on you to prove otherwise.

Hi twinsmum, i have read your success and congratulations to it. It was with firstplus was it not. If so when did you take the loan and how long before you won etc. Did you go to the FOS or he court route. Also were Freedom Finance the brokers.

Thanks for any reply and sorry to be asking only you are the only person i know that has won.

I went to the FO in the end, my loan started May 2005, it took along time to finalise my claim though almost 6 months in all, but you keep going I am sure they will pay up eventually. No it was not Freedom Finance it was CentralCapital.
Claimed back almost £4000 so far from HSBC for mis-sold PPI
£2083.00 + £242.00 8% interest from FirstPlus and lower monthly premiums:D Studio Cards paid off my account and gave me £125.00 in gift vouchers. £500.00 Barclays.

also i have sent complaint of unfair rebate to first plus

whereas you have won miselling and unfair rebate from first plus alone?

I am still confused can anyone help??

can i accept the money frist plus are offering for unfair rebate then get the remainder owed from norton??

Rang the FOS this morning about this SIN payment added to my account and have quoted the passage from my letter saying it was deducted at the time of settlement and they are no saying it was interest added to my settlement and should of been added. They waffled on about the rule 78 adding this amount because it worked that way and then she admitted that she had made ANOTHER mistake and should of written added instead of deducted. I thought they had made a mistake in adding it but she says it should of been added. She says she made an admin mistake in her typing. She said she does not really undertand the financial side and her job was in the data side. I then asked why she typed the letter and she said that she had consulted another person there and that she had not understood. I have today written another letter to the FOS to put with my claim and this time i have stated lots of acts and oft passages. I hope this makes it through the investigation stage.

    Hi m.colak,
Thanks again for the quick response, hope the move went well. Can you point me in the direction of the mis-representation act, so I can print a copy off for my brother please.

    Thanks again

I have composed the following e-mail to Barclays (via my online banking):

I took out a loan with you in Apr 04 (ref 3209579659/1603)I paid 20 payments, I settled the loan in Dec 2005, I had paid £8082.80 and the settlement figure was £10269.29, I was given a rebate on 22 Dec of £750.72. Could you please explain your calculations as I believe them to be in serious error. I look forward to a prompt response, or I will have no alternative but to take my complaint to the FOS. Many thanks. Is this enough? hopefully they will see the error of their ways, I am holding off on pressing send until you experts on here give me the go ahead, do I need to include
anything else. All comments greatly appreciated. I have sent a separate letter regarding the PPI and am waiting for a response, keep up the good work everyone!

MColak, what do you think - is this enough, advice/suggestions greatly appreciated
LTSB PPI - £770 ish for dad
LTSB PPI for dad - £1800 for dad
    Barclays PPI claim for self-£2204

Yep it seems ok maybe change the wording so its a little bit more official like:

    Dear sir/madame,

I am writing in reference to the policy xxxxxxxxxx and this was settled on the xxxxxx with the amount £10269.69. On xxxxxxx you credited myself with a rebate of £750.72. I appreciate the credit however I would like now to have a full breakdown of the figures relating to the settlement of the account including, but not exclusively, any additional interests, charges, rebates and methods of calculations made to this figure. This is so I can see that the figure you derived was accurate, and in no way disproportional to the final actual amount of money I paid for the policy. I appreciate you time and effort in this matter and hope that you will be expendiant in your reply in order to settle this current query i have.

    Many thanks

    x

ps if you have already asked for a SAR you should include about it being ommited from the original request for information.
