No post today, nothing exciting news of anything, and still waiting for some replies from FOS.......

  • What do I do next ??
    Lloyds TSB credit card

    1. Sent template letter as I was unaware that I was paying PPI every month and recieved a reply saying I had ticked the box to say I wanted PPI and was given 30 days to cancel etc. Also my monthly statements gave PPI amount on them.

    2. I wrote again asking for a copy of the said paperwork and today get a letter saying the no longer have a copy of the original agreement which was march 2004 and that they consider the matter closed and if not happy go to the Ombudsman.

Can anyone advise me what to do next ?
    Thanks
  • Thanks Di.

I sent the second response last Monday 20 October by recorded delivery. Not received a reply so far.

Have been trying to contact CAB for 4 weeks with no joy. Can't get through to them at all and as i work full time i can't get to the local office in person.

Will ensure that the letter i get says final response so i can send it to the Financial ombudsman and if it doesn't i'll write again asking if it is their final response.

Thanks again for all of your help
  • Thank you so much for your help. I think the letter will come in extremely useful, its worth a try anyway!

    Thanks again

They have to by law provide you with a copy of the agreement and also by law have to keep records for six years from when your account closed.

If the loan is paid off they do not have to provide an executed agreement but they do have to provide a copy.

Get back to them telling them you are taking this matter to the Information Commissioners Office for none compliance and in breach of the CCA.

Does your letter actually read "final response". If it does then yes, you can now go to the FOS with it but do make a complaint to the ICO and also tell them you are doing so as a courtesy...

    Hi there Magnum
It seems you have received the standard template fob off response from these just like myself and others have here from Loyds, mine also Credit Card ppi, due to being a homemaker at the time, and they added the Asset ppi cover on mine even though it would not have covered me here.

If now they said this matter is closed I would now complaint to the FOS here:
    http://www.financial-ombudsman.org.uk/consumer/complaints.htm

Now you will see the forms online or you can also ring them up to send through the post, the choice is yours.;)

With the complaints form, add as much as possible and also enclose copies of any correspondence with the form, and a copy of the final decision from LLoyds.

Good luck and if you require further info hun, just yell.

I tell everyone no matter who you sent to, finance firms, authorities etc, is to post by recorded delivery.;)

    Di.

Oops sorry Marshallka, you beat me to it lol, thanks x

    Hi there
Its very frustrating isn't it when trying to get hold of these advice centres?

Have you tried here for advice, some may be free:
    http://www.communitylegaladvice.org.uk/index.jsp

In the meantime, I wish you luck and if you need further guidance through this please just let us know, we are altogether here and have been let down badly by these firms.;)

Please let us know when you hear from these and we can then help you with the following step from here, good luck !

    Di.

This link is interesting however its confusing it appears to be guidelines but in some of the text appears to say stick to it and do it:

  • Thanks to you both for that. Keep up the good work.
