Just a note to say that my credit card PPI started in 1999 and was cancelled in 2004 and after receiving a Final Response letter, contacted the FOS, gave a few details and they are going to look into my complaint. It may well be useful for anyone in doubt to give them a call and find out if they will investigate the claim.0

It says here there was more than one code of practice so we can just hope i suppose.
Also a passage from this is money says about another case here
"if your loan was regulated but the PPI sale was not. It is a shame in your case because the PPI you bought has all the characteristics that regulators are now trying to stamp out. The premiums were added onto the loan amount so that you were paying interest on them and you are self-employed so would never be able to claim. These are issues with how the product is sold.
But there might be one last avenue for you to pursue in getting your money back. I suggest you complain again to the Ombudsman but this time make clear that it is the policy itself that you are complaining about, not the sale. The policy is from an insurer called Pinnacle and they are a regulated company, and were regulated in 2001. In your complaint, make clear that you cannot possible make use of the insurance policy because you are self-employed. Say that you regard the inability to cancel the insurance and get a reasonable refund to be unfair under the Unfair Terms in Consumer Contracts Regulations"
So what it is saying is complain about the actual policy itself not being fit for purpose and this claim is against the insurer.
I do not know who our insurer is yet but i will do soon as i get my full SAR from FIrstplus and my SAR from Freedom Finance too then i have more bullets hopefully.
This info might help someone. It seems you have to word your complaint right to the FOS and then he can help and you have to know what laws you have in your defence before going to him. I have listed a few in my complaint for them to go at even if the sale is outside their jurisdiction.0 -

I have been in correspondence with both Next Plc and Debenhams regarding PPI claims. I opened the accounts in February 1996 and June 1994 respectively.
For information, if you are unsuccessful with the claim and it is before a certain time, you have to go to the Finance and Leasing Association, as opposed to the FOS.

I'm afraid they are pretty useless - GE tell them they weren't regulated by anyone so haven't done anything wrong (unless it's after April 2007 I think) and FLA say 'OK then' and that is it. Fla cannot enforce them to pay up.

OH has just finished a 5 year loan with Barclays.
It was a £7000 loan, which ended up costing £12000 because of the PP and interest. He phoned up numerous times to try and cancel PP.
Do you think we'd have a chance of reclaiming?

RESULT - had a letter today from the abbey/cahoot and have offered me £442 as a settlement even though i took out the cahoot policy online and didn't speak to anyone :beer:0

Interesting, as I was telling you yesterday, my PPI insurance was underwritten by Pinnacle.

Update....
Had a call from Ben King at channel four news today, had been out and was just coming in through the door when I could hear the phone ringing....the answerphone kicked in before I could get to it .....so I did 1471 straight away and guessed it was his number so called him back!
He asked lots of questions ......told him all about the PPI and the process I had been through so far, how this forum has helped me to get to this stage, and that I am now waiting for a defence etc....
He said they were doing some research and planning a programme, he asked if I would be willing to be interviewed on telly
I said "possibly" a bit shyly and then thought "what the hell".."if it means I get my money back and a chance to slate Freedom Finance then hell YES!"
He said he would get in touch again.
I asked if I could mention his e-mail address on here so that others may share their stories and he said "certainly" so ....here it is.....

Hi, I received an offer from Abbey today refunding all my premiums plus interest, £3k. However, this was not because they refused to cancel my PPI 18 months ago unless I took out a new loan... it was because I took the loan out over the internet which the complaint handler is saying was a 'Non Advised Sale'. Will provide more detail on what was said over the next day or so but this may help others who obtained loans over the internet?
