Oh maxdp, I do hope that the poster comes to take a look at all this and wish you had been on when he posted.

Just keep an eye cause you more on here than me and perhaps you could let him see these things. I feel so sorry for him cause he had debt probs and mental health conditions and still felt he had to pay all back at the detriment to him.

My heart goes out to these vulnerable people. Lots of us make decisions which are wrong but when you do not have the ability to make these decisions at the time they should be protected.

    Enough of my rant:D

8968.00 (amount of ppi with interest) - 2185.95 (repayments against the PPI) = £6782.05 - the rebate i got of £91.64 = £6690.41(THIS IS THE AMOUNT THAT I WAS UNFAIR REBATED ON)

So if Firstplus work this on this pro rata basis then 78% of the amount they took from us at settlement for PPI that was in fact dead and buried is £5218.51 and then add on the statutory interest which would be 5218.51 + 2338.51 = a whopping £7556.51.

That is worked out on the pro rata thing as well allowing that they be able to keep 22% back for admin etc.

I hope and pray this is upheld now. I want back the £6690.41 plus interest really as I don't think they shoud keep anything back for admin etc. Does the FOS argue this for you if you win..if this is worked out correctly then on this £6690 plus the interest it works at £9689...:D

    Elloo

Have looked it up and I haven't got a clue how they work it out. It doesn't seem to add up to me but then I am useless with figures.

Yeah Di, get it posted up here...all that you need is the Details of the Loan and PPI and how many months til you settled and then the rebate against the PPI. It doesn't matter if they used rule 78 or not, just if the rebate was unfair.

Will do thanks hun, will post up shortly.;) Will dig out the paperwork.

He was dealing with them and like he said, he could have walked away but did not. I have the utmost respect to anyone like that.

I know how they work now Anne.Jade. I know how to work the misselling ones too. They have ripped me off good style here. I want it all back and will fight all the way now knowing the figures.

Just found catinthehats post about the pro rata that FP work by and here is tiggraes response to it

Ok the 78% tends to be FP's norm (after taking into account administration costs etc)

The pro-rata figure is worked out on 78% of the remainder of the premiums (ie they are ignoring what you've paid todate as they don't believe it was mis sold!!)

They've worked it out on on a 5 year basis (ie 60 months) of cover - not the length of time you'll be paying for it - the 16 months is just to prove they are complete morons and can't work out the number of months since August 2004

Write back - tell them to stick it - you want all your money back, plus interest, plus 8% statutory interest - if they're not prepared to offer that ask them to put it in writing and say it's there final response (they should come back very quickly and say it is there final response) then send all three letters onto the FOS refer to your case number

I think the FOS gets it all back for you if you win.
