    Received the same holding letter last week.

    RBS/OA have been criticised in two decisions now for their lack of co-operation. Pity the FOS can't seem to do anything about it.

    16 months and counting.....

    I dipped into this thread around the time that Virgin stopped following BOE base rates to the annoyance of us all here. I admired those of you pursuing this with them and glad you've had some positive outcomes.

    I wonder if anyone can advise whether it is worth my pursuing too,:

    * Opened a/c in Aug 2001, so just a few months short of the magic 10 May 2001 letter than seems so important

    * The facility was increased and I ported it when I moved house

    Even if those two factors don't make a difference - have I just missed the boat on this one?

    I was wondering the same thing ? - have read this on and off and kept meaning to get on with complaining but never got around to it (mainly due to illness) - oppened a/c in 1999/2000 and increased facility in about 2003 but have no paperwork from the very early days. Is it still worth it ?

    Hi Chinkle,

    The crucial time period when OA were marketing the base rate tracking was from the beginning of 1999 up to Aug 2001. If your decsion to open a OA was influenced by any of these marketing promises you could have a case.

    The result of porting/changing facility is still being determined at Ombudsman level, as mentioned in the thread above.

    You would have to go through the OA complaint procedure first.

    However, I seem to recall from an earlier thread that there may be some time limit involved as how long after the interest rate change that a complaint would be accepted.
    Update: It was 10 posts (and 3 months) ago from Monkeypuzzel:

    I received bad news from Ombudsman today, I opened in Feb 2001 and increased facility twice in the past. The ombudsman has dismissed my case
    because of the increases and because i apparantly took too long to complain... I left it until early 2009 to make 'official' complaint to the bank..
    I will appeal.

    Hi, yep thats what they said, but I have now too taken it on to the Ombudsman stage.. still waiting.................

    Saran, is that rejection based on the fact that you changed your facility?

    That is the only difference between other succesful complaints but not explicitly stated in the decision - just another factor. tbh the decision does not provide any explanation other than to say "not persuaded by the arguement". Not very satisfactory but cannot be taken further with the FOS.

    Very poor service from the FOS as far as I am concerned.

    The Ombudsman, Clare Mortimer, does not even do us the courtesy of covering all of the points raised in our submission.

    Maybe a complaint about the Ombudsman may provide another route, as, after 16 months of waiting, I am completely dissatisfied with such an incomplete response, and quite angry.

    This is not a re-hearing of the case but rather a complaint about they way it has been handled, i.e. not consistent with other complaint outcomes, full explanation of reasons for decision not given, etc
