god, i am still so angry,and i did loose the plot with the idiots at aktiv, now what i want to know is how and who do i report them to.
the story is back in Dec i ask Aktiv for the CCA on the a/c, they couldn't supply it, they have had all the letters, they acknowledge they didn't have any paperwork but they were still going to collect the debt !!!
any way they have sent many letter most with some sort of threats, i have just binned them, the phone calls also were a pain, so i sent the "don't phone me letter".
well this weekend they have been phoning, which i did tell them they shouldn't and i would not confirm my details, (that really gets them ! ),
so to the problem from today. got home at 5.30, middle son said there had been a call from "Steve at AKTIV KAPITAL" and could i phone him, he also left my A/C number with the same 14 yr old. I was so angry i phoned them, but Steve was on the phone and i could only speak to a stupid woman, she said they were in the right phoning and leaving messages, i was so angry at that point i told her to shut up and listen to me as i was not going to have my details left with a child and that i was going to report them.
now i have had a rant, who do i report them to?

i didn't think that they were as it would be admitting that Ms. XXXX had an account with them in the first instance, and to give out the account details is surely REALLY bad as any mum/sister/housemate could fill in the blanks of and what is your date of borth rubbish that they ask as security questions...

They have been harassing me for weeks. I'm a victim of id theft. I wrote to them with all the details explaining the debt they were chasing was nothing to do with me and related to an address I have never lived at.
They still kept phoning I told them the same thing everytime, they still phoned. Got the Police round gave AK the details - they still phone ! I try to reason with them makes no difference except they now phone twice a day.
I reported them to the OFT via the OFT website.
This is their reply:

I am very sorry to hear about the difficulties you have been experiencing however, the OFT has no authority to become involved in disputes between consumers and traders and so we cannot offer you any direct help with the complaint or advise you directly in this matter. Our role is to protect the collective interests of consumers.
The Consumer Credit Act 1974 (the Act) establishes a licensing system to protect the interests of consumers in the credit area. If a business wishes to undertake the collection of debts that arise from consumer credit agreements then the Act states that they are required to hold a consumer credit licence; this is issued by the OFT.
Aktiv Kapital (UK) Limited does hold a consumer credit licence. Under the Act, the OFT has a duty to consider the fitness of all traders who hold consumer credit licences.In considering fitness we take into account whether a business has engaged in improper business practices. Where we receive complaints about the business practices of licensees, we investigate them and where appropriate we take enforcement action; that action depends on the evidence and circumstances. Action the OFT can take includes revoking, refusing or suspending a licence; or placing conduct requirements on the licence of the company or business in question (failure to comply with a conduct requirement can result in a financial penalty being levied).
The OFT has issued guidance to consumer credit licence holders engaged in the debt collection industry. The guidance is intended to ensure that debt collectors treat debtors fairly. Non-compliance with this guidance will call into question the fitness of licence holders and applicants. Thankyou i will report them also, mines been going on for years.Spoke to FSA but they said can't do anything because it started in 2006.I've even got copy of credit agreement, only one christian name and surname the same. phone no. on it rings. I,ve been passed from one creditor to another, Its amazing how much info i have on this other chap. DOB. NI.no mothers maiden name that he's self employed. The list goes on, If i can find this info an ordinary jo soap. Why can't creditors and investigators get it right without assuming it must be any body on electoral roll with same initials, He even lived apx 25 miles away.

Definately the Information Commissioner in your case. That' will liven them up. Plus the Trading Standards nearest their office, who license them.
Read the OFT Guidelines first and quote the items that they are breaking.

It's the OFT that issues (and can revoke) a Consumer Credit License. Make sure you complain to them as well.
Since the beginning of this month the OFT have been given enhanced powers to enforce their guidelines and revoke licenses if necessary. They can't take action on an individual complaint, but they will use it as evidence against a DCA/creditor if enough complain about the same company.
They have already given 13 DCAs/creditors a warning this month to clean up their act, or they will lose their license.

7. The Credit Services Association (CSA) estimates that there are around 450 to 500 debt collection businesses in the UK (where debt collection is the primary activity) of which approximately 292 are members of the CSA.
6. Since the OFT's debt collection guidance was issued in 2003, action taken by the OFT has resulted in the issue of nine notices to debt collectors that the OFT was minded to refuse or revoke their credit licences and a total of 137 warning and advisory letters have been sent to 120 licensees.
So one quarter of DCAs have had some sort of warning from the OFT!
