I agree with Mrs P Pincher, I'd definitely try Jessica Gorst Williams at the Telegraph; she thinks that Abbey is a "shower". Threaten them first and give them a week to respond and then write to her. Be prepared to ask for proper compensation over the delay; they seem to spend more on this than anything else.

    Good luck!

i had a similar experience with hbos, last year & again last month they sent letter demanding payment on an account i closed 2.5 years ago.... they were very unhelpful with providing statements (actually wanted £10 per month for each month i wanted)

I sent them a Section 5 Subject Access Request under the Data Protection Act
    https://www.consumeractiongroup.co.uk/forum/bank-templates-library/96518-data-protection-act-subject.html

they have 40 calendars days to provide *everything* related to me with a maximum fee of £10 for the entire information.... failure to comply with these regulations leaves them open to a £5000 fine.

They will give you all the paperwork you need.
mine did & for the 2nd time accepted there was no debt & they made a mistake... i will keep the paperwork for the letter they send me next year demanding payment...

    Abbey are a shambles.

I know this comment might not be helpful, but I totally agree with this statement and they have become worse since they've been taken over by Santander..... Hopefully once you'll get it sorted out, you can change banks.

bank statements (or the information contained within) are considered personal data for the purposes of the dpa. as others have said, they should reply within 40 calendar (not business) days. it doesn't really matter whether they believe you want it for a claim or not.

have you kept any letters you've sent/received?

Still no joy from the Abbey!!! We have kept a copy of the recorded delivery letter we sent them 3 weeks ago, and we havent heard a thing back from them. My partner is going into the local branch again today, to talk to the same customer service guy as last time. He had rung up and asked for the statements on my partners behalf ,and assured him we would have received them by yesterday...arghhhhhh!!!! Its driving us mad....lol.
