BBC is hardly a reliable source. Its easy to pick holes and inaccuracies in many articles they publish.

OK, perhaps you'll believe our very own Martin?

Step 2 is the part you need to read.

Data access requests cost a maximum amount (£10 IIRC). Provision of duplicate statements is allowed to be charged per statement (and is considered a valid charge). So, that doesnt fit with the data access rules.

Both articles point out that if your bank is going to charge more than £10 for the statements the Data Protection Act is the route to go down. Because that way they can only charge you £10.

Pedantic, maybe, but statements are not data...they are merely a medium for delivering data.

Indeed, Martin (in the above article) does not mention asking for statements. He says...

"Let’s be honest, how many people have six years’ worth of statements. If you’ve online banking access, first see what’s available there, if not send a letter to your bank requesting a fully comprehensive list of all past charges."

Banks may choose to send the data in statement form, but I don't believe they *have* to. Wasn't there a time when the banks were deliberately just sending lists of charges, ie raw data, in an attempt to confuse claimants?

Fair enough, but a statement is a list of transactions to and from your account. Any "list" they send you will have the details of which account it pertains to, so the same as a statement.

A statement would be the easiest way to send it as all they do is enter two dates and hit the print button. Any other way would involve manipulating the data to make it not a statement.

I know of someone who used the Data Protection Act to get copy credit card statements on several cards (and possibly bank statements too) for a tax enquiry as needed them for several years and this was the cheapest option.
Don't put it down, put it away - thanks Valli

Weve still not had a reply from the Abbey!!! I dont know what else to do now:confused:
  • Get hold of the most senior person you can reach at your local branch and tell them what has happened and that you are going to refer the matter to Jessica Investigates in the Daily Telegraph (column printed on a Saturday) and that you will be looking for compensation for the delay both in providing the copy statements and the consequent delay in finalising the financial settlement and then if that doesn't work, follow through!

Abbey are a shambles. They are paying out a small fortune in compensation at the moment to people who are not having simple requests responded to and a basic standard of customer service.

Keep a written note of dates and content of all conversations and who you spoke to.

    This is not acceptable!

  • I know it may be an obvious thing but have you tried logging on online? Most of the main banks now allow past statements to be generated there?

If there is no joy there, I suggest speaking to the most senoir person you can (as Mrs P P suggested) and state that if you do not have a resolution within a timeframe you will be referring the issue to head office, and the Financial Ombudsman (FOS). Follow this up in writing to the person you spoke to, and address the letter/email directly to them. That may make someone there sit up and take notice of you.

Don't let them get away with this shocking service!

The FOS may not look at it but it will get some attention.

Its unlikely but they could refuse a data request for statements and they are allowed to do that when they believe a complaint is coming and you are fishing for evidence.

With Abbey though, anything is possible.
