Victim of Debit Card Fraud - Advice Please!!

  • Ladbrokes don't need CV2 number to deposit - I have done it many time without. The deposit form states that you enter the CV2 number but many times I had done by leaving it out (because I didn't have the card with me).

    However, your case is a strange one.. unless someone is really bored, why would they open a bookies account in your name with your details? If a withdrawal was to take place then it would be refunded back to your account. Also most bookies, require the billing address to match your registration address before you can make a deposit so even if a cheque was requested it would be sent to you.

    I would ring up the bookies and discuss it with them. Find out when the transactions were made. Was anyone money actually used for betting. If not then maybe you can get a refund back into you account. If it was used for betting, then I'd guess you'd have to talk to the police. Maybe you'll have to prove where you were when the transactions were made to show that it could not have possibly been you.

    Although I think most banks are scum, I can see it from their view in this particular case. You may get a dodgy scammer who stuck on a bet with a bookie.. lost.. and instead of accepting the loss, tries to scam it back from the bank by reporting a fraudulent transaction.
  • I'd call the bookies again and check what details they have - Full name? Correct address? Correct date of birth (due to needing to be 18+ they always take) . Make sure they put a stop on the account and ask if the account has any other cards registered, any bank details registered, an email address, anything else.

    Have you any idea how someone could have got all that info? Where have you used the card & given out those details?

    Then go to police as identity fraud. The bookies might have recorded the call, but as it is now so late, not much chance of them still having a tape. But that is up to the police to investigate.

    Also send a complaint to the ombusman now, as you have the banks final decision.

    To be honest if someone has stolen your card to gamble with your details, they are either incredibly stupid, have a serious gambling problem or someone who wants to get you (not a pleasant thought).
  • Just to reitterate a couple of points above:

    If you have used your card for payment, in say a restaurant, the card details could have been copied down. Or if you have purchased anything on line or over the phone you would have to have given the same details.

    I would include these points in your letter.

    For your card issuer to hide behind their current stance is unsatisfactory.

    I would consider threatening (and carrying out) court action for the sum involved. Give them 7 days notice to put the situation right, and advise them if they fail to do so you will instigate legal proceedings to recover the amounts in question.

  • there is a problem here surely? Will Hill and Ladbrokes for their phone or internet service refund the money back to your card, so surely any winnings would be refunded back again onto the card. Have you checked statements to see if there were refunds back onto the card around these dates as well?

    Ladbrokes do allow you to collect winnings in store if you have an on line account, but surely then there is a case to say that they may not have identified the person winning correctly?

  • Got a reply from the banks fraud dept saying they stand by their decision not to compensate me!!!

    Tried getting info from william hill but the bloke on the phone said he couildnt give that sort of info out over the phone and I'd have to request it in writing (due to DPA).

    Finally got through to the Detective who is investigating the matter at my local CID - he was honest enough to say hes been away dealing with a murder enquiry and has only picked up my file yesterday so the bank has made their final decision with no input whatsoever from ther Police -is this normal?

    I want to take this to the Ombudsman- do i have a case?? And also when giving details to the ombudsman should i give them thre RBS's head office as contact address or the fraud dept's.

    PS - i mentioned to the police officer that its idiotic for someone to steal my details then go and use it on gambling transactions but he said its very common these days! Damn theives!!! Arghhhhhh!!!

    Moreover I have provided you with all the information needed for you to investigate this matter correctly by answering all your questions honestly and providing you with the police details etc.

    I now have all the paperwork ready to take this matter to the Financial Ombudsman however before I do so I’d like to give you the chance to re-evaluate your position.

    I therefore urge you to investigate this matter further and reconsider your decision regarding compensating me for this fraud.

    Please reply to me within 7 days stating and explaining your final position so that I can then arrange to take this matter further.

    I wrote them the above letter after i received their final decision and this is their reply below: (word for word)


    .".......Dear Mr XXXXX

    Thank you for your letter of 13th September. I am sorry you were unhappy with the service you recently received, but grateful you took the time to write and explain why.

    Unfortunatly, it is with regret that I must advise you that the Bank stands by its decision not to refund the transactions in question.

    I Realise that you will be disapointed with this response, however card fraud is a serious issue and we therefore have stringent policies in place. In the circumstances we would advise you to pursue the matter with the Police, should you choose to follow that course of action, than Bank will of course, co-operate with the authorities.

    A leaflet is enclosed which explains more about out complaint procedures and includes details of what to do if you are unhappy woth the outcome.

    Also see How useful FO was in the A and L case ongoing in This section.
    Are they aware of your debt probs and could this have infuenced their decision?
    The details from the bookies should provide interesting reading!

    A few people have wondered about how the crooks get the cash.

    Easy, just lose it to an accomplice in heads up poker. Ask the police to find out from the bookies where the money went. If it was lost to the bookie, then they are looking for a gambler. If it was lost to other customers, then they have leads to investigate.

    After reading this and cranston's thread I am certainly glad I dont bank with RBS. Their letters and treatment of customers is shocking!
  • I would report them to the Ombudsman... Thank you for sharing this with us! Now I know I will never bank with them. And dont take any insurance with them (esp. Tesco) either!
