I'm not exactly sure what you mean here.....

    You say:
If Pollycat had kept them then I don't think there's anything the company can do about.

    but then say
since the goods were given away the company can still claim for the value of those goods off Pollycat, assuming it's not more than 6 years ago

I'm not disputing what you're saying here or querying the law, but to say that if I keep them there's no comeback but if I give them away there is, sounds a bit strange to me.
If I said I'd used the uncollected speakers but they'd failed so I skipped them, what could the company do about it?

    It's over the 6 years anyway. :T

I was going to say myself that it was a bit strange. But that's British law for you. It was the case when I had something similar happen to me on two occasions and I believe the last time I saw this discussed on the forum. When I first heard it I didn't think that could be right but the laws I looked at at the time (can't remember the specifics now) I couldn't see anything that contradicted that and it seemed to be the only conclusion. I think it's mostly down to the fact that the goods were sent mistakenly and are not unsolicited goods (but I may be wrong). If it was ever disputed I guess you could always demand storage and admin fees etc to counter sue. ;)

Thanks for the clarification, I thought I was missing the point.

    But, as you say

I think that just about says it all.

I should probably make a disclaimer that I could be completely wrong. I'm no lawyer. But that's what I could make out as far as I could (without the headache becoming too great).
