vendor wants to comlete on friday but move out on saturday!!!

Is this allowed?

I personally dont think its fair, we've got vans booked, days off booked etc. The vendor has said they cant get the day off on friday so they want to stay the friday night and move out saturday morning.

    The house belongs to you on Friday and they must complete with vacant possession. You are totally in the right. Tell 'em where to go - cheeky so & so's!

    well, if you complete on the Friday, then the house is all yours on Friday.

    but some people will let them stay the night, and move on the Saturday.

    It's really up to you. you can tell them no, that you've agreed a completion date for the Friday, so you will have to get the time off.

    or you could be kind and let them stay the night, but if they accidentally burn the house down on Fri night, its YOUR house

    And if they decide on Saturday they don't want to leave until Sunday...or any other time soon?
    It's your house but you can't as I understand just turf them out, unless I'm mistaken you'd need to go to court to get possession.
    Very, very dangerous. Speak to your sol soonest is my advice.

    I agree - it's your house on friday, so if you choose to move on saturday it's up to you, not the other way round. Personally I would tell them to poke it, and have them out, so you can start moving in.... Good luck with the move. It's a stressful time as it is.....

    Of course if you want to let them stay then I am sure your bed and breakfast rates are reasonable !!! After all, it's buying into your mortgage once you have signed not theirs !!

    The contract is for vacant possession. This happened to my friends and the vendors paid for them and their chldren to stay in a hotel overnight and arranged a lock up garage for the stuff they had driven up themselves. However, it took them ages to move out the next day and from that experience, I would insist that they meet their contractural obligations although I don't think it is worth losing the purchase over at this stage.

    I agree with Ian W that you are on slippery ground. It worked out okay for my friends but it is a risk.
  • When contracts were exchanged a completion date was included; otherwise the contract was invalid.

    Therefore the vendor has made a contract and you should make clear to them that you expect them to comply.

    In real terms, if they don't there is little you can do about it. Any expenses you incur, due to their breach of contract, can be re-claimed but that can only be actually enforced by the Courts.

    Have you discussed this with your solicitor?

    I assumed that contracts had not been exchanged yet, but if they have then they have already agreed to vacant possession and they will just have to sort it out.
  • The vendor rang me last night whilst i was in the gym, started kicking off saying that they had no where to go! I tried to explain the situation to him but he wasn't having none of it. I told him that he should contact the estate agent, we have exchanged contracts.

    The estate agent calmed him down and he has agreed to be out on the friday for lunch time.

    The whole experience of buying a first house has been quite enjoyable (so far) getting earache off the mrs is what is stressful!!!

    The first 20 years are the worst, mate!! During that time the male body develops a finely tuned coping mechanism called - selective hearing. The earach is still there, but it's more of a background noise that doesn't impinge too much on lifes real pleasures like the footie, Ashes, Open Golf etc. Trust me on that one!!

    the male body has come along even more & mutated so much that the coping mechanism gene, scientists have found, is apparant at birth - it's now being employed with mothers, not just wives, so any statements like 'only an hour on that computer', 'you have a mobile, use it to let me know if you're safe' & 'no, Jordans jugs are not wicked' all disappear into white noise!
