Talktalk / Tiscali Transfer Nightmare! Mac Code related!

Hopefully someone can help me or point me in the right direction! I am having an absolute nightmare with Talktalk at the moment. I phoned up in Feb to get a MAC code, which after me having to call them up three days in a row they eventually ley me have one.

I then passed this on to Tiscali as I assumed I should have so it could get cancelled and transferred...

Tiscali took over our broadband in the middle of march but I have since had TWO bills from talktalk for moneys for the same broadband.
Now I have emailled talktlak on this matter saying I didnt even use them anymore and have swithced but they say I havent cancelled my broadband contract and from that date it would take up to 28days for this to happen (28days from my email on the 25th March when I received this bill!!).
But I gave tiscali this MAC code and have tried contacting Tiscali on this matter but get passed from deprtment to department on that one.

Am I in the right by refusing to pay this Talktalk bill as I have done all I was supposed to, and I have even reitterated the MAC code back to talktalk proving they had given me one and in reply they seemed taken aback but insisted they had no notes that I had never asked for one (even thou I rang up three days straight for it!)

I cancelled my DD when Tiscali took over and when I knew my last proper payment to Talktalk was due so I'm also now being charged on the talktalk invoices £3 for nonpayment of DD!! As far as I believe I dont owe them anything since Feb 23rd as thats when Tiscali took over but as I say, they are sill charging me for broadband of which I'm not even using. And it does not take 28days surely to cancel a broadband conncetion?? When I asked in Feb they emailled me saying it would be 14days, I swear they've increased it because of this arguement.

Help please. I hate Talktalk and just want this all to go away, they're not cooperative and I really really dont want to have to give-in an pay for this when I did all was asked of me with the MAC code...

  • Was your contract with TalkTalk up?
    Have you paid TalkTalk everything you owe them?

    If were you outside your minimum period, you're liable for charges up until 30 days after the day you requested your MAC. (By requesting your MAC, you gave the 30 days notice you're required to give to end your contract).

    I requested the Mac code 8th Feb, everything is paid by DD a month in advance so has been paid for, but I since got bills for March AND now April..

    Is that ABSOLUTELY true, so by asking for the MAC code is basically me giving them the 30 days notice? Also, they say they have no notes of me asking for this MAC code (conveniently enough!!) even thou I have given them the dates I rang up on, AND the MAC code they'd given me itself...

    But it in me asking for the MAC code is notice of 30day cancellaton then that should be the end of it, and I shouldnt owe them this money!


    (And I have been with them for three years+... so contract is all ok to cancel!)
    Word of advice for others- NEVER GO WITH TALKTALK!!! Pff,

    Out of interest what package have you taken with Tiscali ?

    Although some ISPs state that asking for a MAC gives notice of termination of contract (if MAC used within 30 days) it should not be assumed that that is the case. Talktalk make no mention in their T&Cs of MACs asking instead that you write to them 30 days in advance :

    10.4.2 to end the Broadband Service or the Mobile Service, you must tell us in writing 30 days in advance of leaving us...

    I had the same carry-on when I left TT and had to write to
    TalkTalk Telecom Limited, Stanford House,
    Garrett Field, Birchwood, Warrington, Cheshire, WA3 7BH recorded delivery slipping in a mention of Otelo along the way.

    deklan99, there's no need to assume anything. ;)

    Ofcom makes it very clear that requesting MAC = giving your notice:

    Ofcom - Broadband migrations: enabling consumer choice
    General Condition 22: Service Migrations
    Annex 1, A1.22, page 81



    "When the LSP is notified that a migration has taken place, the customer's notice period (i.e. the date at which notice to discontinue service is taken for the purposes of calculating any outstanding subscription charges under the contract) will be taken to have commenced on the issue date of the MAC, or on the date of any prior notice to terminate, whichever is the earlier."

    (LSP = Losing Service Provider)

    That leaves me thinking... Hmm, what period did that last bill that you paid in February cover? Does it cover any time beyond March 8th? If so, not only you don't owe them a penny, but you could actually ask for a refund (for your unused days) and turn the tables on TalkTalk. :cool:

    Nope, still not getting it, however page 87 point 11 does say :

    The customer’s request to the LSP for an authorisation to migrate does not in itself represent a request to terminate service with the LSP.

    Can't see how that equates with "making it very clear that requesting MAC = giving your notice "
    Maybe I'm wrong? :confused:
    Would guess that in the OP's case either Tisacli have not informed Talktalk that a migration has taken place using the MAC and/or Talktalk are waiting for written confirmation as per their T & Cs.
