If it is proved you owe the money I think you should make every effort to pay it back. Personally I think you are looking for a way out of not meeting your obligations.
Its a bit like a film on tv I saw recently with Leonardo Decaprio called "Catch me if you can" and as with that character they have caught up with you.
Firstly, while something may be morally and ethically wrong to you it doesn't not mean it is legally wrong.
Secondly you cannot relate someone with serious mental illness (being sectioned shows the illness was serious) running up debts to the character in "Catch Me If You Can". You may not be aware but some mental illnesses make people act recklessly which includes spending lots of money.
If the banks had not relaxed their lending criteria and kept an eye on who they were lending to the economy wouldn't be in the mess it is, and having a go at people like the OP doesn't help anyone particularly as the bank has sold the debt on.I'm not cynical I'm realistic

I wasn't going to post my reason for not being aware of this debt, but your post has frustrated me due to you being a little judgemental about our situation.
Back in 1996, I suffered a nervous breakdown due to a physical assault and continuous harassment from neighbours (I am gay) I had my home windows put through, graffiti all over the external walls and car, etc, etc, I was sectioned under the mental health act, whilst in hospital, alternative accommodation was sought.
From being sectioned to arriving in my new home took over 8 months, whilst in hospital I received psychotherapy treatment to prevent flashbacks from the assault and harassment, once discharged my social worker took care of my finances and correspondence until I felt able to take control.
I had no knowledge of this debt, until last week when contacted by the debt company, you have no idea how far I have come in the last few years recovering from the events I suffered in the 90's, but you just carry on being judgemental with posters, whatever pleases go, I trust you get enjoyment from it.

easy to preach.bet he/she is a debt collector or bailiff.when you have no money or very little,what comes first food and a roof,sod anything else.and over the years banks have made so much on us with very little,they would be the last people i,d pay.so keep your snobby self rightous comments to yourself.we are here to help one another,that is us the workers of this country, with very little to show for a life time of hard work.0

I bet you have never stepped out of line in your perfect life have you! I bet you polish your gold bank card and cheque book every night before you go to bed, do you send gifts to your bank manager and send a thank you card to the council tax people every month after you receive your bill? Stop being silly, if you have severe financial problems in the past and your only option was to walk/run away from it, then do it! Life is too short and don’t kill yourself over some poor financial judgments. OP, don’t even acknowledge this waste piece of paper, destroy it and get on with your life.
Nice post. However I add about 30 years ago I was deep in debt after losing my job and did not know which way to turn. In those days you did not have the support like you have now. I owed about £5,0000 and thought the only way is bankruptsy. So I sent along to the courts and filed for it.
I then had second thoughts and managed to get it cancelled the same day.
I contacted all my creditors and they were brilliant. In particular John Lewis
partnership.
I managed to get so temp work which evenually lead to a permanent position
and about 3 years later paid off all my debts.
So yes I have been there and now speak from experience.0 -

Following on from my OP, I took advice from National Debtline, phoned my local county court who informed me the CCJ was granted in July 1997, and also found a template letter somewhere in one of the threads on this site re "Statue Barred Debts" I sent the letter to the debt agency informing them of the "Statue Barred" timescale, and that the debt was unenforceable without taking leave of the court.
Today, I have received a reply from the debt agency, stating the debt is NOT statue barred as a CCJ was obtained at the time, their reply goes onto say they will accept weekly / monthly payments giving a sort code and a/c number for me to pay into.
Their letter ends stating I must reply within 14 days.
Anyone know where I stand, or any template letters I can use?
