  • I'm sure there would have been terms and conditions when you ordered the tickets in the first place, but obviously as they've sold out now there's nothing to check and verify with x

OK, I don't know a lot about you but are you a regular Cardiff fan or someone who fancies a day out at Wembley? I ask that since to get to the tickets section of the website, you'll have to go through the main page of the site and 'tickets for Wembley' has been a story/ies on the front page for about the last three weeks with varying bits of information being released as to how people can qualify for the right to buy tickets. Similar information has been published in the local press and other unofficial websites.

I admit I'm not sure where they stand legally but I believe the club has made all reasonable efforts to publish the criteria as far and as wide as possible to ensure that regular supporters got tickets and not opportunists (this is a general comment and not intended towards the OP)

  • I can remember on the BBC website it said about who could purchase tickets before they went on sale.

I'm sorry, but my loyalty or otherwise to the club is irrelevant ... I am a casual supporter who goes to the odd match, and wanted to support his team on a big day out.
However, if I was unable to buy a ticket as a non season ticket holder, this should have been stated when I bought the ticket - it was not. I did not search the news section of the website, merely followed the links to buy tickets. I followed the process though, and if at any point it had said do not proceed if you are not a season ticket holder, I would have not committed to buying the tickets.
Even not being allowed these ticket is fine - that is the choice of the club - the thing that annoys me and I am wondering the legally of it charging me a £10 admin fee for refunding my payment.
In light of banks and credit card companies having to charge a reasonable amount in fees to justify any work done in relation to going overdrawn etc (Again, which is clearly stated in their terms and conditions), I am wondering how they justify a £10 fee that was not stated anywhere when purchasing the ticket.
  • You could try writing to the club itself, I find writing letters gets more response than ringing, failing that you could ask your credit card company about refunding the further £10, might be worth a try.

  • Every football fan knows Season ticket holders get first dibs on tickets like this. You should have checked this information before purchasing the tickets. You have to wait until ST holders get their tickets its the way it works. In summary wait until they have gone on general sale otherwise things like this happen I'm sorry but its a costly mistake. There have been every effort made to notify people of the conditions of sale.

Except build a website where customers were authenticated before they were allowed to buy!

I have sympathy with the OP - he's being asked to pay for their laziness in not developing the website fully IMHO. Would have been very easy to add a tickbox saying 'Please confirm you are an ambassador/ST holder'. They shouldn't be relying on the user seeing instructions elsewhere on the site or hearing the arrangements in the press. What if he'd been sent a link directly to the buy page?

Your chairman is Peter Risdale. Did you expect anything else?
It's taken me years of experience to get this cynical

In fairness to the club, it's 81 years since they faced something similar so it's hardly an everyday event for them to have to deal with:D

think it is quite dodgy personally, it is very plausible for say me, who knows nothing about football, i want to buy tickets for my brother, im not going to sit there reading through the news section and the law wont expect you to if it is a significant term it should be brought to the consumer's attention if it was in the t+c's fair enough but if not i wouldnt think it would form part of the contract
please dont take this as legal advice but here is some of my contract law notes
    i) Document containing notice of clause must be integral part of contract
ii) Term not usually disputed if included in document which is signed
iii) Term can't be part of contract unless put forward before contract signed
iv) Not binding unless person whose rights it restricts is sufficiently aware of it at time of agreeing to it.
    v) Onerous terms must be highlighted

i would definately be arguing with them its really not fair

ps. i dont know if tickets fall under the distance selling regulations -> in these cases they can't charge an admin fee for cancelations
    Yes Your Dukeiness :D
