Could O2 do anything?
I recently had ALOT of trouble with O2 over a faulty phone on contract. They eventually sent me a new phone and a jiffy bag to send the replacement phone they given me (which was slightly scratched and worn) back in.
Anyways I dont think they ever gave me an address to send it.
This was about 6 weeks ago and nothing been said and I've got two SEk850i. If I was to sell it on eBay or something would anything happen?
I know its dishonest etc etc but I'm in no rush to tell them to give me an address to send a phone back to with the mess they made with my faulty one.
Any thoughts?

When a handset is being returned the normal process is to order the replacement straight away and when the returned one is scanned in (from the imei) the replacement order gets released.
For you to have a replacement of a replacement without the IMEI being scanned in, someone has manually had to override it. Therefore the original 'replacement order' (the one you are wanting to sell) will flag on the system as being active and no reason selected for return. This will most likely be investigated, found that the phone is still in use, and barred, and a bill sent.

Sending a bill in this instance is potentially a violation of the DSR.

Erm... nope. The link you have provided clearly states it is illegal to send a bill for unsolicited goods. However, in this case, the goods were not unsolicited, as they handset was requested as a replacement on the understanding that the original would be returned.
O2 are perfectly entitled to bar the original handset and bill you for it if you do not return it.I accept no liability if you chose to rely on my advice.0 -
