help seller now says they have to order goods

    Well parcel turned up an i refused to accept delivery and have made a report to trading standards. Will go and set up a paypal dispute now

    They got them to you in 2 days and that's not quick enough?

    And you are going to report them to trading standards and paypal???

    Bad bad mistake, you have got your goods in 2 days you will not win your paypal dispute and trading standards will probably have a good laugh, whats you ebay username ?

    I ordered the parts as they said mostly next day delivery, four days later they emailed to say they would have to order them and could take 2 weeks. I coudn't wait that long as am carless so i ordered alternative parts got them next day and fitted them.

    As SOON as they told me it would be longer i emailed to cancel the order as they are a business seller they are bound by UK law which gives me the right to cancel 7 days after recieving goods so i canceled before they even sent them.

    Point is its not my problem if they cant sort their stock stuation out, don't sell it if you haven't got it in stock. And if they don't like uk trading laws dont trade in the UK. Not too bothered if do'nt win paypall as will simply take it to small claims court as they are breaking the law and where i can add resonable expenses to it now i recon this has taken about an hour of my time so far which is not that cheap. I am not going to be out of pocket due to their incompetence.

    You may have a problem there too. I believe you need to make a claim in the small claims court nearest to the defendant.

    OP, you're quite within your rights to have rejected the delivery, as long as you can show that you had requested to cancel in writing before they despatched the goods. Consumers can cancel a contract at any point before delivery without prejudice - for any reason even as simple as 'I changed my mind'.
    Don't take any nonsense or pay any 'restocking fees' or 'admin fees' either, the seller has to take the hit for this one.

    If you can't get a voluntary refund, let your PayPal dispute (for items not received) run. The only way a seller can win a PP INR dispute is to provide proof of delivery. If you've not signed for anything they won't be able to and PP will find in your favour. Offering what you don't have for sale is bad practice, and you shouldn't lose out if they implied they had it in stock and ready to go.

    If your claim is for a fixed amount of money (a ‘specified amount’), and the defendant is an individual who defends your claim, your claim may be transferred to the defendant’s local court. This may mean you having to travel some distance for any hearing that takes place. But, if you win the case, you may be able to claim your travel costs and something towards your lost earnings for that day.
