help seller now says they have to order goods

i ordered some car parts on the basis that i needed them this week and seller quoted 5 days for delivery 9they had 5 identical ones listed). The have now sent an email saying they don't have them i stock and are going to back order them and they are going to be two weeks.

Now these parts are not particularly cheap from this seler but could not find them elsewhere.

hey are a power seller and having gone through their feedback when this has happened before parts have take up to 2 months to come, i cannot wait this long.

Have emailed to say that this is not acceptable and would like a refund. but juging form whne this has happened they have not been forthcoming.

cab i initiate a paypal dispute on this one if they dnt give refund?

    Send him an email saying you can't wait, and you'd like a refund.

    If you don't get one, (give him a few days to action it) then open a dispute.

    Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

    If you purchased them on a Buy It Now, you have the right to cancel the sale under the Distance Selling Regulations. As a business seller they should be well aware of their obligations on this matter!

    Many thnaks for that have already emailed asking for refund if its not forthcoming may send another mentioning distance selling regs and failing that paypal dispute.

    With the distance selling regs is there a limit of seven days as it took them 4 days to email me that they didn't have them.

    I feel for you!

    Same thing happened to me some time ago (car parts too). Seller had 2-3 days postage in his listing.

    I waited 6 weeks for delivery! the Seller defended it by saying, "They were posted first class as soon as we received them from our suppliers so the postage claim was accurate"

    I lost the dispute :(

    Drop Shippers........... I HATE them, they should be banned. If you aint got it, don't sell it!!!!

    well following another email sent this am quoting distance selling they had sharpishly responded (bit of a stroppy one) telling me have to wait 30 days as per distance selling and why bid if won't wait

    why list multiple of the same item stating most sent next day when you don't have it got a feeling will get a neg out of this one blemishing my 100% +ve since 2002 and may end up going via small claims court /trading standards but at least wil enjoy writing neg i return

    Right now after a bit more advise this afternoon have recieved a message from the seller saying they have now dispatched the goods despite two emails stating i want to cancel and i have already ordered (and recieved) altenative parts not quite what i wanted but carless at present!

    Should i contact trading standards that cover their area re ignoring distance selling regs?

    Open paypal dispute (on what grounds?)

    What should i do when (if) this parcel turns up should i refuse it, so saving return postage cost? (could be tricky as expecting so other parcels but hopefully obviuos from size). Are they going to send me something random?

    Well parcel turned up an i refused to accept delivery and have made a report to trading standards. Will go and set up a paypal dispute now
