I have a o2 contract which i took out via the internet in december. It was for the Nokia N95 £40 contract. After receiving the confirmation of the contract via email i was told the mobile phone would arrive to me in 2-5 working days... after the 5th day had passed i called the contact center and they told me the mobile phone was not in stock and i could be waiting for up to a month for the phone to be delivered. I literally told him to forget it then and told the associate that i was going to cancel and not to bother sending the phone as i had seen on the vodaphone website they had the upgraded nokia n95's in stock for the same tariff and price. A few weeks passed so i assumed the contract had been cancelled and the phone had not been sent. So i preceded to get the Vodaphone contract. A week passed and low and behold the o2 phone came through my neighbors door and he passed it to me the following day as i was not in. I rang o2 immediately and they told me i had to sent the phone back to the address inside the box. I checked and there was not one. so back on the phone i was and waited for 45 mins in the queue and eventually put the phone down. That week i was working nights so i slept through the day so decided to take the phone into the nearest O2 store and ask them to deliver it back.. where when i got there they told me i could not do that and gave me some address to send it back to that i HAD TO PAY FOR?! When i got home i rang o2 again and checked the address and it was correct though the advisor told me i had passed my 14 days return policy by a single day and if i wanted to cancel i would have to pay £630 termination fee. so i decided to sell the mobile phone for £150 to help me on my way as i am only 21 years old and not on mega money. And proceeded to pay £40 per month till i changed job and had to go a month without being paid, so i missed my Direct Debit twice and was sent a email saying i needed to pay £600 termination. I could not afford that so had to sell my VODAPHONE phone to fund the payback to half the bill so my direct debit could be re-instated so i could continue to pay monthly... i have used this contract once for a 20second phone call and sent no text messages tho my allowance is 700mins and unlimited texts a month... i am really struggling and need to get this contract off my back is there anything i can do? Thank you for your time.

    Your voda contract is binding.

    You could contact them, tell them you are in financial dificulty, can't afford to pay and can they assist (maybe by cancelling the contract, but allowing you time to pay off their early termination fee "on the drip")
  • yea i got no probs paying my vodafone contract as i use it. its just o2 i dont want or need it and surely they can check my usage and somehow we can come to an agreement? well i need to do something as i cant afford to pay 40+ a month for something i dont use...is there any way you can transfer the contract into another name and let them use it and pay it?

    I misunderstood your post and thought it was the voda contract you want to get rid of.

    But the answer is the same for the o2 contract as well - it is also binding.

    (The same suggestion goes for o2 - see if they will help you in any way).

    Otherwise is there anyone you know and trust who could take it over. I doubt they will let you change over the name, so you would need to trust whoever to pay you the bill each month.
