Using someone elses credit card

My neice, having been ripped off by our local garage big time, told the garage owner, when her bill was double the estimate, that she couldn't pay it and all she had on her was her boyfriends credit card. The owner said that that was ok and got her to sign her name on the receipt! Surely this can't be legal?
Any advice would be greatly appreciated as she is worried that what she has done is fraud.

I'm 99% sure that that isnt legal, but someone will pop upwho definately knows. I jsut wanted to tell you that my parents have done a simular thing in the past as a total mistake. They have the same cards so mum had used dads and didnt realise till later. The upshot was they called the CC company and told them the mistake they had made and the CC company rejected the amount that had been put through the card and they went back into the place they had used it and repaid the bill.
Simular type thing, so it does happen by genuine mistake so your neice could play it that way.0 -

Similar thing here. My OH 'borrowed' my credit card for a quick trip to the local shop. Dispite the fact that my card says 'Miss' he walked in punched in the chip & pin numbers and off he went. Makes me worry about this 'chip n pin' thing a little.Baby Year 1: Oh dear...on the move

My OH went to Tesco , did a shop for £140 AND petrol using my Connect card just by knowing my PIN !!

So many till people dont even handle the card to put in into the Chin N' Pin thing its worrying. I understand what CnP is all about and on the whole I think its a good idea but when a bloke can get away with using a card that states 'Miss' or 'Mrs' on its a bit dodgy. Isnt there special holo pictures on the cards to prevent copies? And isn't the point of this to prevent fake cards being used? Which means the cards have to be handled......
Has there been any new trainning on Chip and pin use for thoes who work in shops?I remember when this was just a little website! :money:0 -

Im not saying that its a bad thing when its your OH (or other family member) using the card, rather when its fraud, such as a stolen card.I remember when this was just a little website! :money:0 -

sorry , was a bit flippant , i prefer the old days , what was wrong with signing for it , train staff to check signatures properly and we could go back to that :TKeep on keeping on... :beer:0 -
I nearly posted on this on Saturday but it was sorted by the time I got round to it.
We went to Tesco for petrol and (yet again) the pump we went to had faulty pay at pump so I went to the kiosk. We had used my OH's card in the pump so I had that in my hand and it wasn't until we actually got home 20 minutes later that we realised I had used it to pay. I had to actually sign the slip as the chip and pin was down as well! I rang them and told them and have received a rather weak apology. Will be getting petrol again this weekend and am going to see whether they check the card.
They will get their cash as OH is a secondary cardholder on my account so the CC company will be none the wiser.
Mind you, I would have been mortified if she had noticed in front of all the other customers but better that than let a theif get away with it.0 -

Having read this again, she is right to be worried about it being fraud. I presume her boyfriend does not object to the payment being made. Lets just hope they dont fall out any time soon.
It would be satisfying to smack the garage where it hurts (in their pockets) by reporting this, but of course the person most likely to suffer is your niece. It would be her word against theirs that they said it was okay.0
