Orange contract dispute

I want to cancel my contract with Orange but they say I signed up to a two year contract which is not up for another year.

I have checked the form i signed and there is a tick against the 2 year option.

However I was not asked or told about this when upgrading (otherwise I would not have signed).

Is there anything I can do or am i stuck for a year?

P.S. There is no need to flame me for being a bonehead and not noticing it before signing the form.

    Hmmm i thought it was a 1 year contract that was renewed when you upgrade. It is possible they ticked it after you had signed - i wouldnt be surprised.

    I think you definately need to get onto customer services, kick up a big stink. Would you agree to staying with them if they maybe gave you more minutes/texts, reduced the line rental? You may need to negotiate better if you will.

    Part of my reason for cancelling was because they wouldn't upgrade my phone for the same price as it is elsewhere (and because they have charged me for 5+mb of GPRS that i never used).

    downgrade to lowest tariff and pay up with 5% discount is probably your only option so £160ish should get you out of teh contract. Potentially sell the mobile you got to offset some of the loss.

    if yous igned without checkingthe smallprint there is not much else you can do. they won't upgrade when they've no need to offer you an upgrade(or a decent upgrade). Youcould probably dispute the GPRS for a while, can they provide details of whenit was menat to be used. You ahven't used it for surfing on a laptop have you or downloaded some large e-mail by accident?
  • I had an idea and spoke to retentions as they have a bit more 'power'. I explained the situation and highlighted some simple maths..

    cost of phone upgrade (£75) + current tariff (£25pm) multiplied by more years of loyalty is financially better than no upgrade fee - reduced tariff and cancelled contract next year.


    The best they could offer was a reduction in the cost of the phone upgrade to £25 the £300 contract cancellation fee still stands!!

    Next step: Letter of complaint.

    You could try by upgrading and then canceling as if you think about it, if you cancel you enter a new 12 month contract with which you get a 14 day cool off period to see if you want to keep it or not, Just an idea...
