ebay dispute

i received a refund through paypal for an INR. the seller then informed me that ebay would automatically generate an unpaid item dispute that they would close once i replied. i did but they didn't respond. ebay now say that the seller has advised that we have mutually agreed not to complete the transaction.
is it right that the dispute was generated by ebay? i have had two sellers in the past that have not been able to complete, both refunded, but no dispute.
also, the terms of mutual agreement seem to be that either i returned the item or there was a misunderstanding.

    thanks eyelinerprincess. i have just re- read the email from ebay and you are right. my problem is though, i paid 16/02 and they refused t refund (told me to claim from rm). they also started npb dispute 17/03, the day i was refunded then failed to close the dispute as promised. they too (i have read your thread) are a powerseller with 98.9% pos feedback. in the last month they sold 687 items with 12 neg and 14 neutral. whilst i understand that if you are posting that amount some are bound to go missing all 26 have very unpleasant responses, accusing the buyers of dishonesty. for the first time i actually want to leave a negative, even though i know i will spoil my 100%. will agreeing to a mutual prevent me from doing so ?

    The only thing that prevents you leaving feedback is failing to respond to an unpaid item dispute.

    Good to see someone with the guts to leave a neg where it's due.

    You need to leave a negative, it is only fair that other buyers know what they may be getting themselves in for, and it will count against the seller's performance rating. A mutual transaction cancellation will not prevent you from leaving feedback, and yes you may well get a negative back, but leaving a polite and factual follow-up will show other people that it was a reatlitory neg.

    If they are selling that number of items, they could well be using a mail collection service, and if one full mailbag has gone astray somewhere (rare, but not impossible), then that could explain the mass loss, but there is no need for the attitude they have given you, and to threaten an Unpaid Item Strike after paypal have refunded through the dispute console is a poor trick to play, but is easily reversed under appeal.

    What is more concerning is that the seller said it was up to you to claim from the Royal Mail. Almost everyone knows that the seller has responsibilty to prove delivery, which is why Paypal awarded you the refund.

    thanks fay, though i am not sure i will feel that great when they post their inevitable reply. judging by the previous i will be branded a cheat, liar or scammer at best! i don't want to be mean by doing them out of their ebay fees by not agreeing to a mutual, but on the other hand i don't want to fund their feedback i.e. buyer ageed mutual then left negative. what would you do?

    If you leave a neg and get one in return then leave a follow up something like "See sellers other responses to neg feedback and judge for yourself who is dishonest"

    Just a suggestion - (and I KNOW I'll be kicking myself over this) - don't leave feedback until May. The simple reason is that from sometime in May, sellers won't be able to leave negative feedback for buyers, so you'll be able to neg your seller with no effect on your percentage.

    The reason ebay are introducing this is to stop sellers such as yours doing exactly what they've been doing - retaliatory negs.

    I'm quite a big seller, and my stars are all 4.6 - 4.9. I've nearly 11,000 total positive feedback, and a total of SIX negatives. Not once have I given a retaliatory neg, which some sellers have done to get their buyer to mutually withdraw feedback. If I've negged at all, it's been for non-payment or because the buyer has been too stupid to contact me before leaving me a neg.

    Sellers only recourse in future is to put buyers on their blocked list, and respond factually to the neg. This can be seen by all future buyers and will be obvious if it's just abuse.

    So hang fire for a couple of months and give your negative in the knowledge you've warned other buyers without harming your stats.
