    its not true that expenses have to be authorised - they can be added to your claim as "special damages". now these can be questioned by the insurance company who is paying out - but in my experience things such as physiotherapy are not questioned as long as you have the receipts.

    Agree totally with nadnad on this one.

    Assuming that liability is not disputed, "reasonable" special damages will be paid by the third party insurer.

    The cost of physio, which should improve your condition and so reduce the overall potential of the claim, will be paid out. It's better for them to pay for the physio to improve your symptoms and so reduce any claim that you might have for pain and suffering and ongoing losses (loss of earnings, etc.).

    How I wish I had raised this issue three weeks ago. I have given my solicitor a few stern words and the feedback his firm will get to my insurers will not be good.

    He said that if the other insurers organise it, they will pay direct and it will be cheaper for them than if I pay privately. They may therefore only pay me back the difference between what they could have got it for and what I paid.

    Well, I am still waiting for their rep to 'phone me to organise it. I have therefore booked a private session at the hospital tomorrow after which they are going to switch me to NHS treatment anyway with the same physio.

    I am so annoyed because I could have had three physio sessions by now and that may well have been enough.
  • It all boils down to what a Judge would deem reasonable in the very unlikely event that the matter went to trial. It's not unreasonable for you to get physio sorted out asap to improve your symptoms, particularly when the third party insurers can't pull their fingers out to get something arranged themselves.


    I'd get started on the course of physio and then claim back against the third party insurers. If they offer an alternative during your course of physio, you can reconsider your options. If they then offer to fund the treatment directly, that might be preferable to you.
