    Going back to the original poster, agree with other advice that you should be looking to get treatment asap. The longer that the treatment is left, the greater the potential for ongoing problems.

    If you need the treatment to be funded by another party, you've got no real option but to keep pursuing the other side. You'll need to get solicitors to act on your behalf. You could get in touch with the Citizens Advice Bureau to give you some local advice.

    A least it sounds that you have a pretty open and shut case against the motorist that hit your friend's vehicle in the rear. Good luck.

    Well I have now found out why I have had to wait for physio and I am so angry.

    When I telephoned my GP on Friday 12th August, she said she had done the referral on the 4th August. I had to speak direct to her as the referral had not been scanned in by that time so the reception staff did not know when it went.

    I rang the hospital today to check the waiting list to give me more weight to pushing for the insurers to pay. They claim not to have received the letter although she did say that my GPs surgery are notorious for sending their referrals en bloc, not on the day they are done.

    I telephoned the GPs surgery only to be told that the letter did not go until the 14TH!!! I asked for an explanation but they could not give me one. I asked to speak to someone who could explain and I spoke to my GP who expressed surprise. She is going to redo the referral and fax it to try and slip me into the fast track system but I don't think that will happen now as it is too late. She is adamant that it would have gone off swiftly but cannot tell me what day.

    It was only when relaying this to my OH that the penny dropped. How did they scan in the referral between the 12th and 16th August if it had been sent outon or just after the 4th August?

    I am seeing my GP about my blood pressure on Monday and intend to raise this then. In the meantime, I have taken this over to the vent board so things don't go too far off topic.

    I have also had to push my solicitor, who now tells me that Diamond have instructed BUPA to contact me to arrange treatment. Unfortunately, thats not a lot of good to me because even if it is at their nearest participating hospital I can't do it.

    I feel like having a good cry right now.

    just to bring everyone upto speed... my friends insurance company have telephoned me, taken details of mine & my daughters injuries, and will get back in touch this week regarding personal injury claim.

    my gp has records from A&E (we went there after 3 hrs as pain started to kick in at that point. she logged what i told her today & said go see osteopath etc & put in claim to the driver who dinged us..... Hopefully he is insured!!!!!!!!!


    thanks for all the info, just to get it dead straight... im right to claim through my friends insurance for personal injury.... yes???? are we agreed?

    you watch, ill get a settlement to cover osteopath etc & it will affect my income support!!!!

    Claming through an insurance co, usually means that they try to offer lower amounts of compensation to keep their costs down.
    An independent Accident Management Company has your best interests at heart, I work for one which specialises in non fault accidents, so if the driver and passengers have not alreadly signed solicitor's paperwork, then phone 0808 144 3311 for further info.
    I am not touting for business just offering an alternative, I will not be making any personal financial gain from it.
    Best of luck in successfully claiming and getting the compensation you deserve, whoever you decide to claim through.

    oh dear, thanks for info, im really not sure what to do, independant solicitor or car insurance solicitor..... I dont want to screw the other driver, i just want my osteopath paid for... my daughter is does Judo and inst able to until her neck & back is better... so i really do want the cost covering.. as a single parent on benefit its the only way we can get fixed...


    Helllllllpppppppppp independant claim or insurance claim? im not going to accept a stupid low offer, and am prepared to argue the toss... if i take the car insurance one, and im not happy with their conduct/offer, can i not then ditch them & persue with independant one?

    anything for an easy hassle free life...

    All drivers are (we hope) insured, it wasnt my friends fault. Surely you should have known that before getting into the vechicle?? insurance???
    not sure what you mean???? my friend IS insured... i dont know if the driver who hit us is!

    As you were hit in the rear both the passengers and the driver of your car will be claiming off the third party's insurer, if he/she is not insured then you will claim off the MIB - a fund paid into by the insurance companies.

    With regards to changing solicitors part way through the claim is not impossible, but your 1st solicitor could ask you to pay the costs so far for the work he has done or claim his share of the costs with the 2nd solicitor when the claim is settled. You may find it difficult for an AMC or another solicitor to want to take over the claim.

    Loopy lass - let your friends insurance company advise you - THEY won't be paying your claim but simply advising you or appointing a solicitor for you, obviously whoever drove into you their insurance company will be paying out - there is no incentive for your friends insurance company to give you bad advice - there is no need to go to an Accident management company.

    thanks, ive checked out the solicitors who were given our case by friends insurance, its corries, they look rather large and appear to act on behalf of numerous other insurers amongst others. They are a no win no fee solicitors, but as our accident was witnessed by a police officer & an indipendant witness its appears to be pretty straight forward.

    Booked myself into a osteopath tomorrow and will get a receipt for payment & add it to our claim...

    My understanding is that expenses have to be authorised before they are incurred. I am going to check with my own solicitor tomorrow because if that is not right I am going to ask the hospital to take my doctors referral and see me privately.

    I have to say I am a bit disillusioned with my solicitor. I have had to chase him all the time, he never volunteers information even though on two occasions he had info of use to me that would have avoided me chasing him.
