Hi
Am having a nightmare with 3 mobile. They have overcharged me £10 a month after I upgraded in November,I was offered 500 mins and 100 texts for £20pm to stay with them,I was paying £25 before for the same mins/texts.I agreed to this new 12 month contract and have been charged £30pm since!
After speaking to customer service for an hour and 4 different people I have been told that this was not offered, which is rubbish! They told me that the contract was agreed at £25pm and can only say sorry to the fact that they have been charging me £30 instead.
I feel that they haven't kept to their side of the contract, they are telling me I would have to pay about £250to get out of it.I agreed to this contract over the phone and haven't signed anything, does anyone know if a verbal contract is binding or can I just stop my DD?

Yes, a verbal contract is just as binding as a written one.

Have you asked for the call to be listened to? Usually in these type of disputes, the phone call determines the contract, even if the notes are incorrect.

Do not simply cancel your DD. Your payments will fall behind and ultimately you could end up with defaults on your credit report.
