My sister lives in North Shields and I come up to Newcastle quite often for the great night out and a spot of shopping in Fenwicks.

I'd still speak to CCCs to see what they would advise you to do, especially since this new debt has come to light!
You can't carry on like this, is there anything else that she's hidden from you?

It's easy to give in to that negative voice that chants "cant do it" BUT we lift each other up.

    Hi

You need some very careful advice if there is no equity in the house.
if you only were to go BK, you ex would become liable for the full value of the joint debts.

Whether she then goes BK to clear them is for her to decide.

Thanks, i have spoken to an IP yesterday regarding iva's and bankruptcy and i'm hoping they will shed some light on to exactly what i can do. I would love to put the bankruptcy back onto my ex as i think she feels she is free of it coz i live in the house and she doesnt now. i think she thinks that since she left its all over with for her and that she can move on now. She would have to consider bankruptcy as she doesnt work and is on benefits living at her parents house.

i will let you all know once the IP comes back to me later today.

Would that affect how i would declare bankruptcy? or would the OR decide how to sort it all out?

Why not have a look through the 'Bankruptcy and Living With It' DFW Sub Board - there is a link at the top of this page.
There you will find lots of advice from posters, including myself and Tigerfeet, who have either gone through, or are considering, bankruptcy.

If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

i hope not, i have got all paperwork from companies involved now and nothing more since december when the most recent company contacted me.
i cant remember any other companies i have had loans or credit card letters from since we split last year.

would the CCCS advise similar to the CAB or would i be worthwhile speaking to both to?

thank you for you advice so far

    Speak to both!
    What harm can it do?
    None!

    thanks Rog2,

i looked through some of posts late last night to see what could be done which is where i got some info from, i will look through more of it today.

i have just had a collection at the door for my documents for the IP to see if and IVA would be a suitable option. they have taken my documents away to see if this would work.

i will let you all know how it goes. Do i need to start a new thread with updates or just post again on here?

    cheers

if you go BK, it does not matter if there is anything else in te woodwork. All debts are covered, even if you do not know about or remember them.
As rog says, there are loads of people who have gone Bk or are in the process on the sub-board and they are a lovely bunch, where you would get a lot of support.

Not that DFwers are a horrid lot, just that the issues are different. If you decide on a IVA, or want help living to a tight budget after BK, then come here advice from the folk who can pare a budget to the bone.

Best of luck whatever you choose to do.
