    A very informative article Bossy, I wouldn't take on trust anything said by some one I was divorcing!

    I just think for a couple of hundred quid or so I would if it was me get a Solicitor to do it for me because if there was any issue it would be down to the Solicitor. I say that and I can do a Divorce myself etc because its my job albeit a trainee.

  • DIY Divorce is the preferred route for muslims in the UK, however, due to greed and ill advice from certain people, muslims are turning to solicitors.

    However, the majority of muslims follow the teachings of their religion. Marriage is a contract and a pre-nuptial agreement is signed before marriage even though it has no relevance in English law. If children are involved, then the couple can come to any mutual agreement but if they can't agree then they would have to follow the Fatwa on Child custody and Contact. This minimises the harmful effects of divorce. Financial agreements can also be reached, however, again if they can't the pre-nuptial agreements would come into force.

    Because of the pre-nuptial agreements signed, certain people think they are losing out and therefore turn to solicitors. The main asset usually the matrimonial home is the sticking issue and according to Islamic scholars the woman's half of the property share needs to be transferred to the children of the marriage. Women would rather have this money and therefore turn to solicitors. By doing so charges are incurred and whatever she recovers part of it will go to the solicitor.

    I am a bit astounded by the phrase "greed and ill advice".

    Why did we get to discussing Muslim ideas and practices on divorce? This thread was started by AuntyJean, who isn't a Muslim AFAIK.

    Just one point: if marriage in the Muslim world is just a contract, nothing more, then if the woman's share is meant to go straight to the children what on earth is the divorced woman supposed to live on???? I've been led to understand that it is extremely difficult for a woman to make a life for herself in the Muslim world without the 'shelter' of some man, either father, brother or husband (rather like it was for us in Jane Austen's day). This isn't the way a modern British woman thinks - it's not a question of 'greed and ill-advice' simply a matter of justice.

    I hope to goodness that we never, never have to live our lives according to the Muslim way of thinking! And before anyone jumps up, I have seen a little bit of it, having worked as a midwife in Saudi Arabia. I nearly got converted to Islam once when I was very ill in hospital, it would have been so easy to be persuaded, but thank the Lord I wasn't.

  • I am not trying to convert you...but this website is about saving money and I was only pointing out that the DIY divorce is a better method as long as it is amicable as stated in the holy book the Quran.

    Otherwise, by using solicitors where litigation always seems to creep in, some of the money which would have been shared between the couple would also have to go to the solicitors involved.

    Please accept my apology to whoever was offended by my message.
