partner moving in - am I in trouble?

hi i have been renting this place for 4 months now and my wife(who was living and working in a different city-now leaving her job to be together) is planning to move in with me by the end of this month. when i mentioned this to my LA, they are keen finding out a date and on doing a credit search on her, which is £120. Do i really have to inform that my partner is living with me ( i have another 5 weeks to go beofre i move out of this rental accomodation to a bigger place)
can anyone please help me with the adverse implications of this - if i don't mention this to the LA for the time being.

just thought to add this- both of us don't have any bad credit history including CCJ or anything adverse like that. it's just that i dont really see any point in spending another £120 credit searching her for just 1 month's stay.

  • The LA are required to credit check any other adult moving in to the property and to ensure they are on the AST.

    If they don't do this and you split up and YOU move out leaving your wife at the property, the landlord is left with a tenant who is not on the AST. He will then be faced with the time, effort and not inconsiderable expense of getting his property back.

    If you don't comply you will be in breach of your tenancy agreement and you could be evicted.

    i have already paid my next month's rent in advace. so that leaves me with the deposit amount with the LA until i move out in 5 weeks. it's shame that i will have to shell out another £120 just for 4 weeks stay for my OH
    any body else - any ideas

    I would not say anything - naughty me, maybe - but I would not

    (if you were not moving out in 5weeks I would think differently but here...)

    Depending of your personality you might just feel worried for 5weeks!

    Yes I agree......if you are planning to move out in 5 weeks then she is only visiting temporarily.

    does that mean IF she is visiting me temporarily, I dont have to notify anyone? is that legit ? i would like to be a law abiding citizen without much trouble. but when it comes to Giving away £'ss for reasons like this , call me stingy - i don't care. but would like to know if I could do what zebulon suggested

    You are entitled to quiet enjoyment of your property ie without interference, so you can hardly be refused to have your wife stay.

    If the landlord needed to evict you/ her, he would serve notice on you, the tenant, and you would be obliged to take all your contents, family, friends & chatels with you.

    It is bit of a nonsense to credit check a person joining a tenancy (unless they wanted to be added to the tenancy in order to give them security). What would the landlord do if your wife failed a credit check? He couldn't refuse to allow he to enter the property.

    Is it a sole occupant agreement? You've already told the LA your plans so it's hardly a secret now and they wouldn't be doing their job to knowingly let you breach the terms of the agreement you signed if that's what this would entail. They may feel living there for 5 weeks in a 6 month let isn't a temporary visit (like the odd night here and there) and that it's a considerable percentage of the term.
    After posting about receiving an email to my MSE username/email from 'Money Expert' (note the use of ' '), I am now unable to post on MSE. Such is life.

    Sorry I have no idea about the legit side of this :confused:

    How on earth can they say she's leaving with you for 5weeks - she could be there for a few days only, you could be storing a few things for friends etc...
    did she never stayed with you for week-ends for example?
    I would just just not tell then anything! (like don't call them say she's staying on holidays for 5weeks :rolleyes: - silence is gold :D )


    i'm sorry if what I say is against "the law" .... but I mean, come one...

    well good luck with whatever is your decision...

    yes i have taken out a single occupancy contract and i'm the only occupant at the property. just doesn't feel too good about parting the money. may be it's the MS instincts in me, may b i'm wrong in thinking so
