Can O2 force you to change your contract mid way through?

I've just spoken to a friend of mine who has been with O2 for a couple of years. Last summer she upgraded her phone and stayed on the same tariff, at £20 per month for another 18 months. She has just had a phone call from O2 telling her there was no record of her "keeping" her £20 contract and that from now on they were going to charge her another £15 per month, so totalling £35 per month :eek: , unless she can come up with the paperwork. Now she's not a great organiser and the paperwork could quite frankly have been eaten by her cat.
Surely O2 cannot do this? They contacted her, not vice versa. It all smells a bit fishy to me. She dealt with a local phone shop, not O2 direct or a big dealer like CPW.
Any advice greatly appreciated.

I'd def fight it.
When I upgraded over the phone last year the paperwork gave no mention of how much I was paying - it just says O2 35 for 18 mths. This is normally £35 per month but I get it for £20, however there is no mention of this on the paperwork itself.
The shop would possibly have a copy of the paperwork, it's a contract so someone will have. Get them to search for it. Also, I'd tell o2 that as it's only been costing £20 per month since upgrade time until now then surely it puts the onus on them to prove otherwise.
Also, as it's only been costing £20 per month on a £35 tariff then your friends bills should have a mention of a loyalty bonus or something similar. Can they check online?If this has been of any use please click on THANKS, it makes me look good.0 -
The shop would have archived the paperwork after 2 months, or at least they should have! So may no longer be on the premises
