    Thank you all for your kind replies.

    I've been in touch with the seller via email and she's just not answering them. I've told her that i've been in touch with the police but clearly she doesn't care much about that.

    Paypal have been very understanding so far, and the dispute is in the final stages (i really hope it doesn't take them long)

    FYI the sellers id is "phina86" ... she now has quite a few negative feedback remarks, so i would imagine there are a few disputes on her paypal account now. Makes me so angry that people can do this. As long as i get my money back then i'll be happy. If paypal can't resolve then i'll give my bank a call.

    So far i'm getting pretty much the same message, that i should win the dispute and get my money back, so fingers crossed.

    I really hate rogue traders on ebay - makes my blood boil - really sorry to hear what happened to you mate - good luck in getting your money back and I hope that cow gets whats coming to her!!
    ALTHOUGH - YOU SHOULD NEVER TRUST SELLERS WHO NEVER USE THEIR OWN TAKEN PICTURES OF THEIR ITEM - YOU CAN NOTE THIS WOMAN HAS USED PICTURES OFF OTHER WEBSITES

    Yeah should have realised this before i even bid on the item - you live and learn i guess. Don't think i'll ever be using ebay again, this has put me off for life!!

    I decided to open my claim with paypal after this, and informed them of the facts. She then 3 days later applied a tracking number to the claim, and it's fake/invalid. LC XXXX XXXX GB

    She's since been left another negative feedback, saying another item hasn't been posted. So i think she's just been on a get rich quick scheme.

    I'm not able to reply to the dispute now, so hopefully paypal will realise she's given a fake number and refund me. What do you think my chances are? good or bad? It's over £100 and i'd rather it was returned to me.

    You need to esculate your claim asap. I've had a few problems from non-senders but I've always got my money back.

    Leave negative feedback and email Ebay helpdesk, tell them the situation occasionally they suspend accounts.

    Seven hours to go on this seller's last listing.

    And sometimes you really do wonder at the naivety of eBay bidders: despite the feedback, and the 89% rating, "Joanne" or "Jo" or whatever-her-name is was still pulling in bids today for the Nokia phone.

    Worst of all: the apparently genuine bidder seems entirely unaware she's in the middle of what looks like a classic shill-and-sting operation.

    The way dear Joanne / Josephine is going about things, she's really looking for a pretty hard fall.

    Hopefully daPOD has contributed to that.

    if its an open listing contact the bidders and warn them about your situation

    Can you believe what's going on!!! I can't believe people are bloody bidding... she had a samsung u600 on a Buy Now and someone with over 300 feedback has bought it!!

    I've sent messages to all the members bidding and to the person who won, advising of the situation.

    She's sold that nokia about 3 times now, people should really learn to look at feedback!!

    Makes me soooooo angry!

    On a lighter note, another buyer has advised me paypal refunded him today, and he opened his dispute a few days before me, so fingers crossed my refund will arrive.

    This seller should have been NARUd.

    Listing reported as fraudulent, though it may be too late in the day.

    I've reported it as fraud too. Hopefully if enough of us do it will get pulled before these poor people get conned.

    Paypals primary object will be to make sure THEY are not out any money. If a side effect of that is that the O/P gets all / some of their money back then that will merely be a secondary consideration for them.
