Can i switch to iphone contract from a 6 months old contract (e2save) ?

Hello,
I have a different type of question.
First of all, let me describe my position, I got a 12 months contract with O2 from e2save (10 months free via cashback). I am receiving Bill direct from O2, not carphonewarehouse. Right now i am at 7th months. And i just sent my 2nd cashback claim.
As 180 days past from connection, can i switch to another tariff ? I asked O2 customer services about iphone contract. they told me i can switch to another new 18 months contract paying £269 for iphone. in that case, don't have to pay any penalty to O2. just switch to new contract with O2.
But problem is, i got the contract via e2save and thats on cashback. If, i switch to new contract what will response from e2save ? might be i will lose rest of my cashback... is there any other effect from e2save ?
It may be sound, madness but i actually want to take a iphone and as my employer will pay line rental...i am not going to lose any money/cashback. just wondering, e2save will not penalize me to break the contract. Though from e2save site, it mentioned that if anyone switch to another tariff within 180 days then there is a penalty..but i m already passed 6 months....So what for me ?

So, can any body help me ????
