Lloyds Bank Loan

HI All, first time for me!! have read newsletters for months and has helped me fight Lloyds Bank, still fighting in fact!! have a loan for £10,000 which costs £229 per month, have been paying it since 1998! had a knee injury last september which needed an op and was signed off for six weeks thought why not claim on my PPI, when i phoned i was told it had stopped when the loan finished!! i said according to my statments i still owe £3,200 on it, then i started thinking god i have been paying this for years!! i was then told that i took another ten grand out in 2001, i said no not me! i asked for a copy of any loan agreement to prove this, they said we don't need one to prove it !! anyway long and short ombudsman been fighting them for me, they are still taking the loan amount out and still getiing nowhere bearing in mind as i see it i have paid back nearly 30 grand for a ten grand loan and they say i stil owe three grand and the loan insuarance has expired !!! anyone got any advice for me please before i go mad !:mad: !!

They have to provide you with a copy of any loan agreement under the CCA.
They will also be able to find out where the £10k that was opened in 2001 was paid to.
How far down the complaining line have you got- notwithstanding the fact that the ombudsman is dealing with this?

i know it sounds like it is made up!! the ombudsman wrote to them in January to tell them to give me some response within 8 weeks, and still all i have back is " sorry but we need more time" the branch, the service recovery centre and so far about three other offices that have had my case passed to them have come up with nothing, it was a woman from the loan protection insurance who phoned to say that as far as she is concerned the insuarance has covered the period of the loan and it is nothing to do with them and the bank does not need to provide any proof of any loan agreements, the only copy of a loan agreement i have is for £10,000 in 1998, even this is not dated or signed but it does marry up with my bank statements, i have a file full of letters to and from the bank and the ombudsman, five months on and nothing0

May I suggest then that you have gone !!!! about tit on this.
Instead of going to the Ombudsman (and it looks like they have given you the brush off) you should have completed the bank's complaints procedure fully first.
Are you sure that in 2001 that some sort of consolidation did not take place perhaps to clear the first loan, perhaps an overdraft or credit card balance or outside finance?0 -
ok points taken on board, but not sure you understand how this developed, my local branch manager took my complaint on for three months and then finally admitted she had drawn a blank on any answers both internally ie in branch and also outside the branch within Lloyds empire, it was her that advised me in december to go to the ombudsman because Lloyds would not give me any answers, expalantions or documents to explain anything. ok as you say supposing that another loan was takent out for 10 grand in 2001 which i truly am not aware of that still means that i have paid back £19,250.28 and they still say i owe £2,703.83 total of £21.954.11 for a ten grand loan, what APR is that as i am no whizz kid with figures! anyway ombudsman in my view are taking it further, they have passed it to a casework support area, so come on lets not be so doomed on my plight !! i feel i have overpayed big time and want it back, unless they can prove otherwise, and i reckon if they could they would have by now !!0

A consolidation loan would have meant that you would have paid off the amount outstanding as at 2001 together with any other loan or credit(?).
You would not have paid £10k twice.
You need to ask for a statement of all accounts you had with Lloyds in 2001 at the time the bank claims the loan was opened.
This will clearly show whether you received any money and if it was used to pay off the original loan or whether there really has been a complete ballsup and you are paying for someone else's loan.
It should not be difficult for the bank to provide this information.

Please check your statements from 2001. Was the money paid through your account? Have you got your original paperwork for the loan? Is the loan agreement number the same?
Did you see an advisor in 2001, could you have possibly re-done the loan?
Sorry for all the questions but these are things you should know.Money, money, money, must be funny....in a rich mans world.

in Feb 2001 according to my statements £10,000 plus PPI of £2,348 was paid into a loan account then transferred to another loan account but no acount number can be found for this! i have no loan agreement for this and neither does the bank, tha branch also said that they should by law have a record of any meetings that they would have had with me and an advisor, but they don't, the only loan agreement i have is for a loan in 1998, this i only know from my statements bcause the agreement is not signed or dated, the bank does not have a copy of this. i have no knowledge of taking out this loan in 2001, since last thread, i have had two letters from Lloyds, one saying they are sending my complaint from Brighton to Birmingham and the other the day afetr saying they are dealing with it at Brighton but need more time and hopefully should have answers within four weeks! 6 months from first complaint !!0

Can you explain more fully about the statement entry. The reply makes no sense.

:money: sorry can't scan it on or anything, anyway have had another reply from bank saying that they agree that the loan was set up incorrectly and they need more time to look into it, but they may if they do not come up with anything repay my loan payments back to August last year and clear the outstanding amount of £2,700. I have also had another letter from the Bank to say that they will no longer communicate with me direct, instead they will answer the complaints through the ombudsman, so something seems to be moving after nearly 7 months!! best open an account elsewhere i think !0

update so far;
loan amount did not come out of my bank this month as it has for ten years, checked on line and the amount that they say was still owing has vanished!! contacted ombudsman he said he has had an offer from Lloyds to settle and will detail this and send to me within a week!
so fingers crossed it all looks good, took eight months, but they are finally holding their hands up !! will update when i hear the rest but the loan has gone for starters!
some people say ombudsman don't help, they have helped me no end !!0
