Where did she get it from?0

Where did you get it, on the phone, internet or shop? if you got it on the net or by phone then i think you have 7 days to cancel, but if you got it in the orange shop then i don't think there is the 14 days anymore.0

Basically - you have every right to cancel. Get it there and get your money back.0

Unfortunately if purchased from a shop their is no cooling off period unless the Item is faulty.
A lot of people also have a misconception that if they buy mail order they are given a cooling off period.
It is correct that you can inspect the goods over within 7 days and if you have changed your mind they can be returned.
BUT if you have used that item, in this case, switching the phone on with a live sim card, then you cannot return the item under DSR, unless agreed with the supplier.

We've bought two orange phones recently and they times they said there was no bringing it back once out of the shop!0

This is correct, 14DMB (14 day money back) was scrapped. & day distance selling still applies, so thats part of why i'd recommend direct sales on the phone or through the web (7 days to review goods!)On the up

My other half bought a new phone and contract in the 3 shop today. He thought he was getting 300 minutes and 300 texts, but it's actually mix and match 300 minutes OR texts. He's already put the sim card in the phone, but not made any calls as the activation date is a few weeks away. Can he take it back or not? Thanks0

As a standard rule, all operators give a 7 day cooling off period during which time as long as you notify them you wish to return the phone and cancel the contract you're alright. So extend this under certain circumstances.
Best of luck.0 -
I took out a contract with 3 via Carphone Warehouse last week. Seemed like a great deal, very cheap, free Samsung Ted Baker phone which looked nice and posh. It's a terrible phone. Horrible. Very difficult to use, makes hideous noises , only a limited selection of nearly identical vile ringtones and judging by the terminology on the screen, appears to have been designed by some geek who thought they were on the Starship Enterprise. Even a techie whizz friend of mine spent ages muttering and stabbing buttons on it before putting it back in the box, looking dazed.
Customer services informed me that it would take a week (at least) for my old number to be transferred. I'm self-employed so to be uncontactable for a week is out of the question. (The assistant in the shop had said it "might be a couple of days"). Couldn't understand a word the woman at customer services was saying on the phone. Terrible English, terrible line. She had to repeat everything at least once.
Furthermore, I did not realise that Carphone Warehouse and Talk Talk were the same people. I have dealt with both technical support and customer services at Talk Talk, on a number of occasions, on behalf of my mother who has broadband with them. The experiences were unbelievably frustrating, leaving me boiling mad everytime so I vowed I would never, ever have any dealings with this company. Ever.
Then I read the discussion on here about users' experiences with 3, groaned a lot
and decided they could have their phone back and I would cancel my contract. Took the phone back to the shop. Unbelievably, there is no cooling off period! They refused to take the phone back, said I'd have to call customer services but they were adamant there was no get out.
Can they do this? It was not pointed out at the time that there was no cooling off period. What if I simply cancel the direct debit and leave the phone in the shop? Will that then go as a defaulted payment and affect my credit rating? Am I really married to this monsterous phone and moronic customer services for the next 18months?
If anyone could suggest anything helpful, I'd be grateful,
Thanks
