They also have them on Amazon at the lower price with free delivery-I always find them pretty good.0

I'd put it in a bag or an alternative box, then go back to the store you bought it from this afternoon with your receipt, and tell them the product is not what you paid for, and you want a full refund.
At the very least, they will have to exchange it for one that DOES have lights, which you can then either keep, or get a refund for (for the price you paid).
If the refuse, get stroppy, demand to speak to the store manager. Stores hate it when a customer kicks up a fuss!Should've = Should HAVE (not 'of')

Point out to Argos that under your statutory rights under the Sale of Goods Act if they supply a product which does not fit the description (ie it is missing the lights it said it had, and which were shown in the picture) then you are entitled to recieve an exchange, or they can supply the lights if available, or they must refund your money.I accept no liability if you chose to rely on my advice.0 -
Did you have it delivered or did you pick it up from the store? How long have you had the item?
If you've had it for less than 30 days then as it's not as described you can return it. Then purchase the one sold at £39.99. I'm confused about the emails saying it's the discretion of the manager whether to accept it back, unless you've had it over 30 days the manager would have no discretion!
Certainly don't accept a £5 gift voucher. You should at least be entitled to your money back or to be provided with the item that you paid for.0 -
Even if it was over 30 days,it is the law that takes precedence,not the companies own conditions.0

I may be wrong, but i think that 'it being at the managers descretion' is because the OP had assembled it, and is therefore considered by Argos as 'used'.
I have seen this stated before on certain items particular catalogue items (particulerly flat pack furniture), where it says 'not included in our returns policy once assembled'
I think argos in this case are just using the technicality that the OP has assembled it, to riggle out of their obligation. (Added to this is the fact that the item is now selling for a lower price, so they will not want to refund and then sell a complete set for less money!!)
Assembled or not, if its not as described, then I would agree, the sale of goods act should over ride any company policy like this.
Any update on this OP, also is argos still describing this as coming with lights on the web site? Im not sure if they were just missed out of this box by accident, or if they are now a cheaper price as they realise there are no lights in any of the boxes and have adjusted the price to reflect this.0
