Help-Virgin sent a faulty phone+wont refund

I was on contract with Virgin and bought a PAYG phone (which was only available for Contract customers at a discounted rate). The phone arrived and it was faulty. I called up Virgin who said they would sent a replacement. Nothing happened for 3 weeks. I called up again and they now say that because my 12 month contract has ended (and no longer a customer), they will not send me a replacement.

Is there anything i can do? Surely there was a 14 day cooling off period. I'm thinking trading standards. What do you reckon?

    Are you sure about this ? Virgin contracts usually just turn into PAYG after the contract is up (or thats what happened to my ones).

    Regardless of whether the contract is up, if the phone came with some sort of warranty then they have a statutory obligation to repair/replace faulty handsets. I would contact them and tell them you want to exercise your statutory legal rights as afforded to you by the Sale of Goods Act (google for the protection this provides to consumers).

    Because i switched my number from virgin to O2, i lost my membership as a virgin customer.

    One can reasonably expect a mobile phone to arrive in working order. Sue them under Sale Of Goods Act. If you need further advice on this talk to Trading Standards or Citizens Advice Bureaux.

    thats crap

    ring and speak to a manager rather than the first person that answers the phone

    they state that if you are not happy with your phone that you purchased within the first 30 days you can send it back for a refund or a replacment

    its on their web page or in the shop

    Your payg phone has nothing to do with your contract - it is separate, doesn't matter if you are in contract now or not. You made a purchase, you are covered by Sale of Goods Act. The retailer does not have to give you a refund straight away, but they do have to repair or replace the handset.

    Virgin now claim i need to get a PAYG sim, register the phone with it and only then will they take my claim forward. Surely this is a load of cobblers!

    Anyone know where i can get a free virgin sim from?

    What a load of cr*p!!!

    You do not need to buy a PAYG Virgin sim! The equipment is faulty and they supplied it, that is the only relevant info, not whether you have a virgin sim! All you need is proof that they supplied the handset ie a note of it on your bill, a delivery note.
