Eviction Notice. Complicated Situation - Need Advice

    Right well, I've been looking into whether the Section 21 Notice served to me is indeed Valid, and apparently it may fall down in Court due to the fact that the Section 21 Notice was served to me by my Previous Landlord, and it's the new LL who's trying to evict me with that Notice.

    I got the information from here http://www.riky.co.uk/more_info.asp?current_id=475

    "6. The landlord has changed during the tenancy term."


    Also, "4. There is not a signed Assured Shorthold Tenancy (AST) in place." Applies to me as well. As I'm on a Periodic Tenancy.

    Would any of you know if either of these are indeed correct and would potentially mean the new Landlord has to re-issue me with another S. 21 Notice and thus another 2 month period to move out?

    Also, Shelter have told me the Dates are all wrong. As I moved in on the 27th May 2006, and therefore because the S. 21 Notice was issued to me on the 5th January 2008, I shouldn't have to leave until the 26th March. Not the 5th of March as states on the S. 21. But the problem with that is before the new LL took over, I was paying rent to my previous LL weekly, and that's what it states on the original Tenancy Agreement. So this would mean the 7th of March then? Not that 2 days helps any, plus the LL has sent me a letter saying I'm allowed to stay until the 12th March, which is a Wednesday, and again doesn't seem right either.

    I may really be clutching at straws here, but I desperately need to borrow more time to find somewhere else to live, which is why I'm looking into every last fine detail that I can.

    The question is, why are you trying to 'hold out' before you find another tenancy???

    Why all this rubbish..look for somewhere else....and move..or is it because you have a bad credit history and cannot find anywhere else?

    Yeah, I can't easily find somewhere else to live just like that. That's the biggest problem for me right now. So I'm trying to stay here for as long as I can basically.Which is why I'm trying (probably in vain) to find a way to prolong living at this address until I've found somewhere else to move onto.

    The thing is I'm not a bad tenant or anything. Infact, quite the opposite. Though at the time I was issued the initial Eviction Notice I was 6 weeks behind on my Arrears, but I managed to pay that back in full. Looks like I'm just gonna have to bite the bullet in the end, sooner or later the new LL is gonna have their way and be rid of me and that's all there is to it.

    Yes, because of the Housing Benefit, get onto the council and see if they have anyone on their books who can take you, the LL are starting to avoid people on HB as they can't get insurance for the tenant. Not being funny but if you are on your own, would house sharing not be a better option??
