Lending money to friends & family

  • Hello!

My boyfriend is having major issues getting money back from his ex girlfriend. Basically, he took out a £10000 loan for her around two years ago (stupid boy), and she was paying the repayments into his bank account.

When they split up she promised she would continue to pay (he has texts proving this), and yet when she found out he was with me, she refused to make the payments. Its hard as the payment is £195 a month- which he is paying out for nothing! He has tried reasoning with her, but she is refusing to budge. She says she owes him nothing after what he did. She also sent him a message which was meant to go to her mum stating that she was laughing as she would have an extra £195 a month to spend in Topshop. With this, plus proof of him transferring the money into the account and her making the repayments into his, do we have a leg to stand on?

I think the original poster was asking if her boyfriend could get his ex girl friend into court on oath and see how good a liar she then is.
I think the answer is yes and maybe BUT the only winner is likely to be one of the lawyers involved?

Now if ex girlfriend needed to demonstrate she was of absolute good character - politician? senior person in a bank? director of a charity ? chartered account? Licensee? then the risk of a civil judgement for debt might be a lever.

"Straw man" and "blood from stone" seems to apply in this case?

He really is stupid. Dump him before he gets you into trouble.

Or maybe, he's the sort of guy who would go to the end of the earth to help the person he loves?
  • i'm sure this is not the right thing??????

Don't lend a money to any one specialy to family members,or best friends, the money is evil, otherwise any relations you had will disappear ...

    trust me :)
  • An ex friend gave me £740 a few years ago. It was never mentioned that it was a loan, nor was there any re-payment schedule discussed nor set up. I am currently un employed so can't afford to pay it back. The ex friend is now threatening me and my family. Does he have any legal right to claim his money back? Can he get it back from me if he took me to court? He gave me a cheque.
