Advice needed please! Overclockers has kept my money for a month...

    speak to the bank and forward them copies of the emails and get them to make a clawback as clearly you have not received the goods. the bank will do this even if you have a visa card as you have never received the goods

    when you get your refund email eclockers and state that you are taking them to small claims for the interest that would have accured at 8% from the 7 days after they cancelled your order

    If its a "Visa" debit card i understand you are covered the same as a credit card, ring your bank and explain you want to do a chargeback

    Thanks to everyone's suggestions so far. Thought I'd give them till end of the week to refund me before taking further action but it's now Friday and no refund yet :mad: This is absolutely ridiculous and I'll be chasing them (again) next week via phone/letter as well as contacting my bank. Needless to say I'll never ever consider ordering anything from them after this :mad:

    If anyone has any other suggestions as to what I could do - prepare to take them to small claims perhaps - then please let me know :)

    Hi Choccy,

    I'm good mates with a few of the managers at OCUK, and they were rather shocked to hear about this.

    Can you get me your order number, and the manager I have spoken to has said he will deal with this immediately when he gets in tomorrow morning.

    (Edit - FYI Manager in question is a chap called 'Gibbo' (Andy Gibson) )

By this time I was getting slightly concerned, so I sent a message to my bank to ask about this refund. This was my bank's response on 18th February:

    Thank you for your secure message regarding the disputed Visa transaction to "Overclockers.co.uk" for the amount of £449.93 that has debited your account on 28 January 2008.

    I can confirm that as of today no credit or refund has been applied to your account from the above merchant. Once a refund is processed the funds will be in your account within 30 days. However I can not confirm when the merchant will process this refund or apply the credit.

    So the refund had never been issued in the first place. I phoned OCUK again last Tuesday (19th Feb), told them it's been over 3 weeks, I've not received my refund, I contacted my bank and they confirmed this. The sales advisor said he would contact the accounts manager, who'd ring me back the following day after 2pm. Almost instantly after I hang up, they sent me this email:

    Dear <Customer>,
    This order has been cancelled and all monies refunded to the credit/debit card used.

    Since then it's been a week, and surprise surprise, no refund has shown up in my account. I didn't get a call from the accounts manager either and it's now been a month since the original order.

    Any advice on how to proceed from here? Can anyone spot anything in their T&Cs that might help someone in my position? The way things are at the moment, they have my money, I do not have the goods I ordered and they took payment on the day of cancelling my order. They've kept this payment for a month.

    5.2 Ownership of the goods shall not pass to you until the Supplier has received in full (in cash or cleared funds) all sums due to it in respect of:
    5.2.1 the goods, and
    5.2.2 all other sums which are or which become due to the Supplier from you on any account.

    Does the above apply to me? :confused: As they (the Supplier) have taken payment.

    Checked my bank account this morning and the money has been returned - took them long enough! Looks like I won't need to go through the hassles of writing them a letter/contacting my bank/small claims any more.

    Needless to say I'll be steering clear of OCUK from now on, and thanks again to those who have given me advice so far :)

    Not just you, even some banks. According to other threads on this forum some banks are now refusing to approve any transactions with OC because there's so much fraud associated with them (allegedly ;)). In the last month or so I'm just hearing nothing but outrageously bad things about them. Which is a shame I used to use them and they were really good. Although I get hardware cheaper now anyway (scan etc).
