I'm waiting to hear on the issue of the assignment, as it is dated 1st September 2008 and the later one 15th September 2008 - they have held the account for last 3 or 4 years........ I would imagine they would have to provide an assignment notice with the original date on......need to speak to national debtline about that one.
Did you not recieva a Notice of Assignment when the debt was sold?
Firstly a creditor must issue a VALID default before the debt can be assigned, did the OC do that?
if you have never had one or both of those, then any legal action would be on shaky foundations from the startThats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all ………….0 -

the 30 days on the 12+2+30 day rimw limit has been abolished which means you only have to wait the 12+2 days now for CCA agreements..
Apologies if its already been mentioned.

As far as I can see, it is only the "offence" that would have occurred after the extra month that has been repealed.
That extra month was never really important because the "offence" was never punished by the 'powers that be' anyway.
The important date always was and still is the 12 +2 days.
If the creditor does not supply the agreement within the 12 +2 days than they are in 'default' of the request, and are no longer entitled to enforce the agreement.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Hi everyone, today is the day I was due to send the 30 day letter. Is it now agreed that this is no longer neccessary? What happens if CCA sudenly start to arrive a0 if they are in order b) if they are not in order?
Many thanks to everyone for previous advice and help.0 -
Sainsburys have written a charming letter to me telling me they are not refunding my bank charges, even though my letetr was actually asking them to put an account on hold while the CCA dispute has been referred to the FOS for adjudication.
Honestly.Almost debt-free, but certainly even with the Banks!0 -
My CCA from Lloyds arrived today - 6 months after I requested it!
Have put it up on CAG if anyone wants a nosey, but I think it's got all the necessary stuff on.
