    Here is a bit of an update from me, My CCA request was up from Welcome finance in June, I sent the default letter and stopp ed paying them. I've not heard anything since, Payplan put my payments to them on hold. They asked me on Monday to find out what is going on with Welcome as we have not heard anything and there interest rate is so high I don't want all adding up. So I phoned them the receptionist said "Aw we sent out that information in June and have been calling you regularly looking payment" Which is all bull, I've heard nothing from anyone, She said I will get your case officer to phone you back. I have heard nothing. What exactly are they playing at??

    They are playing at something, as I say the debt has been in dispute since June, As long as my balance isn't rising with there mega interest, IE pay £30 £65 interest charged.

    Anyone any advice? I have phoned 4 offices, all getting the run around, IE all telling me to phone a different office and never getting anywhere, They are at something, but what??

    You have done your bit , and have kept proof . They have still not come up with a CCA so relax. I recieved a demand from a new DCA today so just told them account indispute and the OC have broken the terms of the CC ACT, by forwarding my details to them . Watch this space .
  • Update on my 1st Credit experience - sent off CCA request on 1st Sept, recorded delivery. Received the notice of assignment quickly, but no CCA (apparently they don't hold it but OC Lombard do) - anyway about to send my 12+2 letter today and yesterday, I received another copy of the notice of assignment with a paragraph telling me its my 'last chance to do something about it'.........._pale_......I'm worried, as you can tell;)

    Thats what GE money did when they realised i knew the responce to my CCA wasnt complete, in my case they dumped the debt and the new owners issued a court summons, very naughty:naughty: , and leaves them in a very weak legal position, but it doesnt mean they are going to do the same, it could just as easily be another bluff :confused:

    Whatever they do as the debt has been assigned to them, you still have the right to see a valid CCA to prove the OC had the right to asign it in the first place in IMO, without it the debt still cant be enforced, so there is a good chance they are just trying to un-nerve you hoping you will pay up.

    All you can do is wait and see what there next move is

    What was the t-mobile for, im not sure if phone contracts come under the CCA to be honest

  • Yep was phone contract (they were HELL to deal with, broken phone, insurance, kept billing me when I wasn't even receiving the service grrrr)

    So do store cards and Vertbaudet come under it then?
  • Yes the others do as far as i can tell, as for T-mobile i would say that all equates to breach of contract by them anyway, i would direct that to trading standerds, they may be able to help at least reduce your liabilaty on that on if you where billed for a service you couldnt use if it was there fault, but that will depend on the exact details of the failure and the wording in the contract

    I'm waiting to hear on the issue of the assignment, as it is dated 1st September 2008 and the later one 15th September 2008 - they have held the account for last 3 or 4 years........ I would imagine they would have to provide an assignment notice with the original date on......need to speak to national debtline about that one.
