The CCA referring to the debt previously passed to AIC NEVER arrived - its now 9 months and another DCA has it now - and they are quiet, apart from pretending to be solicitors now....

Looks like another 'FORMAL NOTICE - ACCOUNT IN DISPUTE' letter is needed, bfy.

You know where to find it by now. ;)

hi all..having real problems with studio ...
had a response..states : we have never stated we cannot produce a copy of the signed credit agreement..with cca requests it is sufficient for us to provide a copy of a caa together with relevant financial info..etc..it is considered that we have complied with your request and therefore this is our final response ... i feel like giving in... they are really tough.... so i dont know wether to get in touch with them and say i am having financial difficulty and need to put account on hold for now : (

Try not to give in westmids. Remember that is the way bullies win. Why not write and say you are having financial difficulties in any case, eeven if they could suppl a compliant CCA (which I doubt.

    Do they phone you?

    Chin up and keep posting.

so they are within their right to do this then : ( ... looks like the easier option i think is to offer token payments of £1 ( not sure they would accept as they are saying minimum payments is £10 a month ) or ask to put my account on hold ..

Have you spoken with any of the Debt Counselling Charites, westmids?

They will certainly be able to advise you of your best option - it may well be that the 'agreement' that they sent you is not compliant.

Have just received something from Moorcroft acting for OC Halifax. I will attempt to upload it here - I'm not 100% sure but I don't think that it contains everything that it should.

Is anyone clever able to take a look and advise, please?

Looks like an application form to me and is not enforceable since it does not contain the prescribed items required.

If that single page is all that they have sent, it contains NONE of the required terms, so can not constitute a true and compliant copy of the original executed consumer credit agreement.

You can see what it should contain, in order to constitute a cca, by clicking on: http://forums.moneysavingexpert.com/showpost.html?p=6815188

Thanks Rog, they just sent the single page. So what do I do next? The letter they sent with it says that they will recommence collection methods in 7 days...
